Local Rules

Investing in Wichita: The Local Rules

Short-term rentals

  • Wichita Code Chapter 3.40 requires a separate $225 annual city license for each dwelling unit used as a short-term rental; the license expires one year after issuance and cannot transfer to another person or address.

For investors: A buyer of a licensed Wichita rental pays a fresh application fee and secures a new license before the first booking. Every ad, platform listings included, must show the license number, and a copy of the license and the city's Good Neighbor Agreement hang inside the unit.

  • Wichita licenses two short-term rental tracks: Owner Occupied, meaning the owner's primary residence with the owner on site during rentals, is allowed by right; Non-Owner Occupied units follow the Unified Zoning Code.

For investors: An investor's rental is Non-Owner Occupied by definition, even a house the owner lives in but leaves during stays. Where the Wichita-Sedgwick County Unified Zoning Code calls for extra approval, that application goes to the Metropolitan Area Planning Department before the license application, and owner-occupied applicants show two residency documents.

  • Each Wichita short-term rental unit must carry $250,000 of liability insurance, which a booking platform's policy can satisfy, and name a contact reachable 24 hours a day who can reach the property within 30 minutes.

For investors: An owner without an address within 30 miles of Wichita must appoint a Resident Agent inside city limits to accept notices and legal service. The application also needs a scaled floor plan marking bedrooms and exits, plus notarized statements that taxes are paid and rental income is reported.

  • Wichita caps short-term rental overnight stays at two adults per bedroom plus two per unit, counting anyone over 12; gatherings may reach double that or 20 people, whichever is less, and end by 10 p.m.

For investors: The code spells it out: a two-bedroom house sleeps six adults, a three-bedroom eight, and a studio gets no extra two. The Zoning Administrator may suspend a license up to 30 days when the licensee knew or should have known the limits were broken.

Property tax

Tax calendar

  • Sedgwick County mails statements in November; the first half or full amount is due December 20, the second half May 10, and late real estate taxes draw interest at the county's posted 2026 rate, 13%.

For investors: The county's rate is the K.S.A. 79-2968 rate plus five points, so it moves yearly: 14% in 2025, 13% in 2026. Parcels delinquent three and a half years can go to the usual yearly tax sale, and street or sewer specials typically stay on the bill 10 to 15 years.

Hazards and insurance

  • Wichita does not appear on FEMA's October 2026 list of Community Rating System communities, so NFIP policies inside the city carry no CRS discount, while Derby, Haysville and Valley Center hold Class 7 and 15%.

For investors: Price a flood policy in Wichita without any community discount to offset it. Because the same list credits three Sedgwick County suburbs with 15%, an identical house in a mapped zone across the city line can carry a cheaper premium, a point worth checking when comparing deals.

Source: FEMA, CRS Eligible Communities (effective October 1, 2026), Kansas entries, Oct 2026

Flood zones

  • Wichita Code Chapter 27.06 makes new homes and substantial improvements in A, AE and AH zones set the lowest floor, basement included, two feet above base flood elevation, with a floodplain development permit first.

For investors: Two feet of freeboard is stricter than the federal minimum, so a gut rehab of a flood-zone rental that counts as a substantial improvement can mean raising the floor or abandoning the basement. Enclosed areas below the floor need flood vents, and a surveyor or engineer must certify the elevation.

Investor Questions

Wichita Investor FAQ

What does it take to get a short-term rental license in Wichita?

A $225 annual license for each unit, $250,000 of liability insurance per unit, a contact who can reach the property within 30 minutes, a floor plan, notarized tax and compliance statements, and a Wichita Resident Agent if you live more than 30 miles away. Licenses last one year and do not transfer with a sale.

Can an out-of-town investor run a Wichita house as a non-owner-occupied short-term rental?

Yes, where the Wichita-Sedgwick County Unified Zoning Code permits it. Any extra zoning approval goes through the Metropolitan Area Planning Department before the license application, the unit is inspected on complaint by planning, building and fire staff, and a $50 fee applies to re-inspections. Owners more than 30 miles out appoint a local Resident Agent.

How many people can stay or gather at a Wichita short-term rental?

Overnight, two adults per bedroom plus two more per unit (no extra two for a studio), with anyone over 12 counted as an adult, so a three-bedroom house sleeps eight. Gatherings may reach twice the overnight cap or 20 people, whichever is less, and must break up by 10 p.m.; outdoor amplified sound stops at 10 p.m. too.

When are property taxes due on a Wichita rental, and who gets the money?

Sedgwick County mails statements in November; pay in full or the first half by December 20 and the second half by May 10, or interest accrues (the county's posted 2026 real estate rate is 13%). In the county's fiscal 2025 typical Wichita example, schools take 44.9%, the city 28.7%, the county 25.1% and the state 1.3%.
