Local Rules

Investing in Hialeah: The Local Rules

Flood zones

  • Hialeah describes itself as a flat, low-lying part of Miami-Dade with groundwater just below the surface, so in the rainy season canals fill and heavy rain can overtop them onto adjacent land.

For investors: Lots beside canals and secondary drainage ditches carry the most risk in Hialeah. Ask whether water has reached the slab or garage, check the city's floodplain documentation guidance, and price flood coverage before assuming an outside-the-zone parcel stays dry.

Hazards and insurance

  • According to the city, Hurricane Irene in 1999 and the unnamed storm of October 2000 left many Hialeah neighborhoods under water for extended periods, with business disruptions and power outages.

For investors: Floods in Hialeah have lingered for extended periods rather than draining within hours. A rental left uninhabitable for weeks loses rent as well as repair money, so weigh loss-of-rents coverage alongside the flood policy and ask how the street fared in 2000.

Source: City of Hialeah, Local Flood Risk, Oct 2026

  • Hialeah has held Class 7 in FEMA's Community Rating System since May 2008, a 15% flood premium credit, while unincorporated Miami-Dade holds Class 3, worth 35%, on the October 2026 list.

For investors: The gap means a similar house just outside the city line can carry a noticeably cheaper NFIP premium, and neighboring Miami Lakes sits at 20%. Quote flood coverage on the specific Hialeah address rather than borrowing a figure from a nearby county parcel.

Transfer tax

  • Deeds in Miami-Dade County, Hialeah included, pay documentary stamp tax of 60 cents per $100 plus a 45-cent surtax per $100, unless the deed conveys only a single-family dwelling.

For investors: On a $600,000 Hialeah duplex sale the deed carries $3,600 of stamp tax plus $2,700 of surtax, while a single-family house at the same price owes only the $3,600. Check the contract to see which side pays it.

Short-term rentals

  • Hialeah stays of six months or less fall under Miami-Dade's standard 6% local transient rental tax, collected by the county, while Miami Beach charges 7% and Surfside and Bal Harbour 4%.

For investors: Because Miami-Dade collects this tax itself rather than the state, a Hialeah host needs a county tourist tax account in addition to the state sales tax registration, and bookings taken directly leave both filings with the owner.

Landlord rules

  • Hialeah's local business tax schedule charges operators of apartment buildings $8 per unit each year, under the real estate and rental classification, with receipts expiring September 30.

For investors: A 12-unit building owes $96 a year. Receipts not renewed by October 1 draw a 10% penalty, plus 5% for each later month up to 25% of the tax, and unpaid amounts can bring a separate $250 fine.

Source: Hialeah Code of Ordinances (Municode, Supplement 45), §§ 86-43 and 86-44, Oct 2026

  • Hialeah allows storm shutters to stay closed only during a declared emergency and for 30 days after it ends, or to protect a broken window or vacant home, with fines of $150 and then $300.

For investors: Tenants often leave panels up after a storm, and the citation goes to the owner. Put shutter removal in the lease or the manager's post-storm checklist, and keep vacant units documented if you secure them between tenants.

ADUs and lot splits

  • In Hialeah's R-1 one-family district, extra fixtures or appliances, or rooms closed off from the rest of the house, create a presumption of an illegal second unit; family quarters need a homesteaded owner on site.

For investors: An attached efficiency rented to an unrelated tenant in R-1 is a code violation, so leave that income out of the numbers. Approved family quarters cost a $200 inspection fee and $100 a year to renew, and must be removed when a sale requires a certificate of re-occupancy.

Investor Questions

Hialeah Investor FAQ

Can I rent out an efficiency attached to a Hialeah single-family home?

Not to an unrelated tenant in the R-1 district. Extra fixtures or closed-off rooms create a presumption of an illegal second unit, and second quarters are allowed only for the homesteaded owner's immediate family, with a $200 inspection fee and $100 yearly renewal.

How much documentary stamp tax does a Hialeah duplex deed carry?

Miami-Dade deeds pay 60 cents per $100 in documentary stamp tax, plus a 45-cent per $100 surtax because a duplex is not a single-family dwelling. On a $600,000 purchase that is $3,600 plus $2,700.

Does an older Hialeah apartment building need a recertification inspection?

Usually. Miami-Dade's county code requires recertification by an engineer or architect at 30 years and every 10 years after, countywide, and inside Hialeah the city's building official handles it. Reports are due 90 days after notice. Single-family homes, duplexes and buildings of 2,000 square feet or less with 10 or fewer occupants are exempt.

How much does Hialeah's flood rating cut insurance costs?

Hialeah holds Class 7 in FEMA's Community Rating System, a 15% credit, compared with Class 3 and 35% in unincorporated Miami-Dade. The city is flat with a high water table, and long-lasting floods followed Irene in 1999 and the October 2000 storm.
