Local Rules

Investing in Palm Bay: The Local Rules

Short-term rentals

  • Palm Bay rentals of six months (181 days) or less owe Brevard County's 5% tourist development tax, filed electronically each month with the Brevard County Clerk of Court by the 20th.

For investors: Guests who are full-time students, or active-duty military on temporary duty who show orders, are exempt, so keep the documents behind each exemption. A Palm Bay lease longer than six months must be copied to the tourist tax office to show it is not a short stay.

Source: Brevard County Clerk of Court, Tourist Development Tax, Oct 2026

Flood zones

  • Palm Bay has been Class 7 in FEMA's Community Rating System since May 1, 2019, a 15% NFIP premium discount, while unincorporated Brevard County is Class 8 at 10%.

For investors: A Palm Bay address gets five points more NFIP discount than a similar house in unincorporated Brevard. Still confirm each lot's zone on the FEMA map, because the discount lowers a premium but does not change whether a purchase needs flood coverage.

Utilities

  • Palm Bay has charged a stormwater fee since 2010, using Property Appraiser data on impervious area plus 15% of pervious area; single-family tiers by building footprint run from 0.7 to 2.79 equivalent residential units.

For investors: A house with a footprint over 4,600 square feet is billed at nearly four times the small tier, so large footprints carry a real fixed cost in Palm Bay. Properties with a permitted stormwater management facility that meets its permit can apply for a fee credit.

Source: City of Palm Bay, Stormwater Fee: Frequently Asked Questions, Oct 2026

  • Palm Bay has billed stormwater on city utility bills instead of the tax bill since October 2020, and moved quarterly-billed stormwater and trash accounts to monthly bills starting July 23, 2026.

For investors: Because these city charges arrive on the utility bill, not with property taxes, escrow will not cover them. Spell out in each Palm Bay lease who pays trash and stormwater, and watch monthly statements on any account kept in the owner's name.

Source: City of Palm Bay Public Works, Stormwater Utility, Oct 2026

  • Palm Bay utility accounts require deposits of $100 for water and $100 for wastewater on standard 3/4-inch or 1-inch meters, plus $30 for solid waste, refunded after 36 months of on-time payments.

For investors: Tenants usually open their own accounts, so these deposits matter most during vacancies or when an owner keeps service in their name. Some Palm Bay lots run on private well and septic rather than city lines, so confirm service at the address before budgeting.

Property tax

  • Palm Bay's charter bars a city millage that raises budgeted property tax revenue more than 3% over the prior year, excluding new construction, unless a council supermajority finds an emergency or critical need.

For investors: The cap limits the city's total levy, not any one bill, so a single rental's city tax can still climb if its assessment outpaces the citywide roll. Voter-approved and bond debt millage sit outside the cap, so read both lines on the August notice.

ADUs and lot splits

  • Palm Bay allows one ADU per property only with the owner living on site, sized from 200 square feet up to the lesser of 800 square feet or half the main home's air-conditioned area.

For investors: The ADU pays impact fees as a mobile home unit and must connect to city water and sewer or meet health department well and septic rules, which can be the costliest step on an outer lot. It cannot be sold separately from the house.

Source: City of Palm Bay Code, Sec. 174.003, Accessory dwelling units (Ord. 2024-33), Oct 2026

  • Among Palm Bay's residential districts, duplexes are permitted only in RT-10 and RM-15, needing 10,000 square feet and 100 feet of width in RT-10, or 8,000 and 80 in RM-15.

For investors: The RS-1 to RS-3 single-family districts do not list duplexes at all, so a two-unit building there depends on older approvals or nonconforming status. Confirm both the district and the lot width before paying for a second unit's rent.

Landlord rules

  • Palm Bay's business tax schedule lists a variable $4.20 per-unit charge for hotels, motels, apartments and rooms; renewals after October 1 draw a penalty of 10% plus 5% a month, capped at 25%.

For investors: The schedule names apartments without a unit threshold or a base amount for rentals, so ask the city's business tax office whether a duplex or small apartment building needs a receipt. Tax unpaid 150 days past due draws a 100% penalty plus collection costs through code enforcement.

What drives rental demand

  • Palm Bay names engineering and defense as its top industries, with major employers including L3Harris, Renesas Electronics and Raytheon Technologies, in a city of about 88 square miles approaching 150,000 residents.

For investors: Salaried engineering and defense jobs support demand for well-kept single-family rentals in Palm Bay. Three Interstate 95 exits connect tenants to the Melbourne airport and the space industry to the north, so homes near those interchanges suit commuting renters.

Products shown are business-purpose investor loans (such as DSCR) secured by non-owner-occupied property. They are not consumer mortgages and are not intended for personal, family, or household use.

Estimates are based on the information you provide and assume it is accurate and complete. Actual terms depend on full underwriting, appraisal, title, and program eligibility and may differ. The rate shown is the note rate, not the APR; figures exclude taxes, insurance, and certain third-party costs. The payment shown is principal and interest, or interest only where an interest-only option was selected; interest-only payments do not reduce the loan balance and the payment increases when the interest-only period ends.
