Local Rules

Investing in Chesapeake: The Local Rules

Rental inspections

  • In Chesapeake's designated Special Emphasis Areas, a rental unit must pass a city inspection before any tenant moves in; the fee is $50 per unit, and the owner, manager or agent must attend.

For investors: A clean inspection earns a four-year certificate, while violations mean follow-up visits and only a one-year certificate. Check the city's rental inspection map before buying, because a vacant unit in these areas cannot be leased until it passes.

Short-term rentals

  • Chesapeake's city code taxes stays of 90 days or less, including short-term rentals, at 8% plus a flat $2 per night; operators register with the Commissioner of the Revenue and file monthly by the 20th.

For investors: On a $200 night the city portion comes to $18. When a booking platform makes the sale, the code makes the platform collect and remit the tax; direct bookings leave that duty with the operator, along with the monthly return.

Source: Chesapeake City Code, Chapter 30, Article XI, Sec. 30-351 to 30-357 (Supplement 148, August 2026), Oct 2026

Property tax

  • Chesapeake's FY 2027 real estate rate is $1.01 per $100: a $1.00 general rate plus one cent for the Chesapeake Mosquito Control Commission. On the city's median single-family assessment of $378,400, that is about $3,822.

For investors: The city's comparison ranks that bill second lowest among seven Hampton Roads cities, behind Virginia Beach. Owners who pay without escrow get a paper bill each quarter, so plan cash flow around four payments a year.

Source: City of Chesapeake Budget Department, Local Tax Comparisons, Fiscal Year 2026-27, Oct 2026

Tax calendar

  • Chesapeake assesses real estate at 100% of fair market value and collects the fiscal-year tax in four installments due September 30, December 31, March 31 and June 5.

For investors: Quarterly bills smooth cash flow for owners who pay directly instead of through escrow. When buying partway through the July to June fiscal year, confirm which installments the seller has paid before settlement.

Flood zones

  • Chesapeake requires the lowest finished floor of new homes in the FEMA 100-year flood zone, and outdoor equipment such as HVAC units, to sit at least 1.5 feet above base flood elevation.

For investors: That 1.5 feet of freeboard adds foundation cost on AE-zone lots, though a higher floor usually earns a lower flood premium. Ask the city early whether a planned renovation of an older flood-zone house triggers the elevation rule.

Source: City of Chesapeake Development and Permits, Floodplain Management, Oct 2026

  • Chesapeake warns that some parts of the city were never studied by FEMA and are subject to flooding, so a parcel outside the mapped Special Flood Hazard Area is not free of flood risk.

For investors: Ask sellers and neighbors about past water on the lot, and price flood coverage even where it is not mandatory. The city's online flood map shows AE and 0.2% shading parcel by parcel.

Permits and occupancy

  • New construction in Chesapeake's flood zones needs two elevation certificates: an interim one when the lowest floor is placed, before vertical construction, and a final one before the certificate of occupancy.

For investors: Build-to-rent investors should line up a surveyor at the foundation stage, since a missing interim certificate can stall the job. For an existing house, Development and Permits will send copies of any elevation certificate it has on file.

Hazards and insurance

  • Chesapeake is Class 7 on FEMA's Community Rating System list effective October 1, 2026, a rating in force since October 2021, which lowers NFIP flood insurance premiums by 15%.

For investors: Chesapeake's 15% trails Norfolk's 25% and Virginia Beach's 20% on the same FEMA list, so similar flood risk can price differently across a city line. Get an elevation certificate early to compare real premiums.

Utilities

  • Chesapeake is the only Hampton Roads city with no solid waste fee for weekly trash collection, and its residential stormwater fee of $11.35 a month is the second lowest in the region.

For investors: The same single-family rental in Norfolk would carry about $402 a year in refuse fees that Chesapeake does not charge. Over a long hold, that gap is a small but real edge in operating expense.

ADUs and lot splits

  • Chesapeake's Fentress Airfield Overlay District, first adopted in 1990, covers lots inside the Navy's aircraft noise contours around Fentress, adding sound attenuation and disclosure requirements to limit incompatible development.

For investors: Buyers in southeastern Chesapeake should check the parcel against the noise zone map before offering. The Navy holds development rights on more than 8,000 acres there, and new homes in the louder contours face added soundproofing cost.

What drives rental demand

  • Census figures in Chesapeake's FY 2027 tax comparison count 28,583 veterans in the city, and 6,069 disabled veterans or surviving spouses received real estate tax exemptions in FY 2026, about $30.5 million forgone.

For investors: With roughly one resident in nine a veteran, a seller may hold a disabled veteran exemption. It belongs to the qualifying owner, so the seller's tax bill can understate what an investor will pay after closing; underwrite from the assessed value instead.

Market note

  • Chesapeake's adopted FY 2027 budget projects real estate assessments rising 3.57%, which the city describes as continuing a return to typical growth after several years of slower appreciation.

For investors: With the rate flat at $1.01, a median home rising 3.57% would pay roughly $136 more. Model property tax growth near that pace, since the budget expects housing price gains to moderate beyond 2027.
