Local Rules

Investing in Deltona: The Local Rules

Rental registration and inspection

  • Deltona's May 2025 Rental Inspection Ordinance requires a city rental license and a passed inspection before a tenant moves into a home leased longer than 30 days, then a new inspection every three years.

For investors: A buyer can take over the seller's license and inspection certificate only by applying within 30 days of the sale; after that both lapse. Units in buildings under five years old skip inspection but still need the license, and an owner living in an attached duplex unit is exempt.

Source: Deltona Code of Ordinances (Municode, Supplement 31 Update 1), §§ 22-234 to 22-237 (Ord. 09-2025), Oct 2026

Rental inspections

  • Deltona's current master fee schedule charges $300 for a long-term rental license and $50 per rental inspection, plus $300 to register a vacation rental, $150 to renew it and $50 for its inspection.

For investors: The code makes the long-term license a one-time charge, so the recurring Deltona cost is the $50 inspection every three years. A vacation rental instead pays $150 every year to renew, on top of the city business tax receipt it must show when applying.

Short-term rentals

  • Every Deltona vacation rental must name one designated responsible party, reachable around the clock, who acts within one hour of notice from the city and checks the property at least weekly while it is rented.

For investors: An owner living outside Central Florida will usually need a paid local manager to meet the one-hour standard. Replacing that person takes written notice to the city a week ahead, and notices served on the responsible party count as served on the owner.

Source: Deltona Code of Ordinances (Municode, Supplement 31 Update 1), § 22-260, Oct 2026

  • Deltona vacation rental certificates expire December 31, renewals are filed August 1 to October 1, and a buyer who does not apply within 15 days of the sale loses the old certificate.

For investors: The application also requires the city business tax receipt, a state transient lodging license, state sales tax registration and an active county tourist tax account. On a purchase the 15-day window is far shorter than the 30 days allowed for long-term rentals, and ownership changes trigger a new inspection.

    Source: Deltona Code of Ordinances (Municode, Supplement 31 Update 1), §§ 22-248, 22-250 and 22-252, Oct 2026

  • Deltona caps vacation rental occupancy at one person per 250 square feet of permitted air-conditioned space, or the septic permit's limit if lower, and requires one off-street parking space per three occupants.

For investors: A 1,500 square foot house tops out at six overnight guests and needs two off-street spaces, because street parking does not count. Only permitted space counts toward the limit, so an unpermitted garage conversion adds nothing; check permit history before projecting bookings.

Source: Deltona Code of Ordinances (Municode, Supplement 31 Update 1), §§ 22-259 and 22-261, Oct 2026

  • Volusia County charges a 6% tourist development tax on Deltona stays of six months or less and collects it itself, apart from the state sales tax return filed with the Department of Revenue.

For investors: Because Deltona's vacation rental application asks for proof of that county account, open it before applying for the city certificate rather than after the first booking. Direct bookings outside a platform leave both the county and state filings with the owner.

Flood zones

  • The Theresa Basin, a roughly 35-square-mile watershed covering eastern Deltona, drains into a chain of connected lakes with no outlet, so high water recedes only through groundwater recharge and evaporation.

For investors: Lakefront and low-lying streets east of Interstate 4 can stay wet for months rather than days after a big storm. Ask any seller there about 2022 high water and quote flood coverage even outside a mapped zone, since prolonged flooding can empty a rental for a season.

Source: City of Deltona Public Works, Theresa Basin Flood Control Study, Oct 2026

Hazards and insurance

  • Hurricanes Ian and Nicole in 2022 raised Theresa Basin lake levels by up to 3.5 feet, and the resulting Deltona flooding did not fully recede until spring 2023.

For investors: The city's study of that event will update 100-year flood zone maps that may supplement or amend FEMA's. A lot outside today's zone near the basin lakes could be mapped in later, which would add a required policy to the holding costs.

Source: City of Deltona Public Works, Theresa Basin Flood Control Study, Oct 2026

  • Deltona joined FEMA's Community Rating System in May 2015 at Class 9 and holds it on the October 2026 list, a 5% flood premium credit; unincorporated Volusia County sits at Class 5, worth 25%.

For investors: Class 9 is the smallest credit a participating community can earn, so a policy inside Deltona can cost more than similar risk just outside the city line. Get an actual flood quote during the inspection period instead of assuming a county-level discount.

Permits and occupancy

  • Deltona requires new construction and substantial improvements in flood hazard areas to set the lowest floor at least one foot above base flood elevation, or 12 inches above adjacent road crowns when that is higher.

For investors: Rebuilding a flood-damaged house near the basin lakes can trigger this rule if the work counts as a substantial improvement. Pull the elevation certificate and road crown figures before budgeting, because raising a slab home can swamp a rental renovation plan.

Source: Deltona Code of Ordinances (Municode, Supplement 31 Update 1), § 90-28, Oct 2026

ADUs and lot splits

  • Deltona's zoning code lets detached second-story garage apartments and mother-in-law apartments serve as accessory dwellings in the RE-1, RE-5 and A districts, but only for immediate family members or as servant quarters.

For investors: A backyard unit on a Deltona estate or agricultural lot cannot be leased to an outside tenant under this section. Underwrite such a property on the main house's rent, and confirm with the city's planning staff before counting a second unit anywhere else.

Investor Questions

Deltona Investor FAQ

Does a long-term rental in Deltona need a city license?

Yes. Since the May 2025 ordinance, a home leased longer than 30 days needs a city rental license and a passed inspection before the tenant moves in, then reinspection every three years. The fee schedule lists $300 for the license and $50 per inspection, and a buyer has 30 days after closing to transfer them.

How many guests can a Deltona vacation rental host?

One person per 250 square feet of permitted air-conditioned space, or fewer if the septic permit says so, with one off-street parking space for every three occupants. A responsible party must be reachable at all hours and act within one hour of a city complaint.

Source: library.municode.com

Why does flooding last so long in eastern Deltona?

The Theresa Basin drains into connected lakes with no outlet, so water leaves only through the ground and evaporation. After Hurricanes Ian and Nicole in 2022, lake levels rose up to 3.5 feet and flooding lingered until spring 2023. The city is restudying its 100-year flood zones.

How much does Deltona's CRS rating save on flood insurance?

Only 5%. Deltona has been at Class 9 since joining in May 2015, the smallest participating credit, while unincorporated Volusia County holds Class 5 and a 25% discount. A home just outside the city line may therefore price lower for similar risk.
