Local Rules

Investing in Gaithersburg: The Local Rules

Rental registration and inspection

  • Every rental in Gaithersburg, from apartments to single-family homes, must be licensed by the city every two years, and staff inspect the interior and exterior before issuing the final license.

For investors: City Code requires the renewal application at least 90 days before the license expires, after which the city schedules its inspection. In buildings with more than two units, the city may choose how many units it inspects and how often.

Source: City of Gaithersburg, Rental Housing; City Code Sections 18AA-6 and 18AA-7 (Municode), Oct 2026

  • When a licensed Gaithersburg rental is sold, City Code lets the license transfer to the new owner on application and payment of a fee set by council resolution.

For investors: A buyer of a tenant-occupied Gaithersburg rental can ask the city to transfer the existing license rather than start over. Put that filing on the closing checklist, because City Code requires every occupied rental unit to hold a valid license.

Source: Gaithersburg City Code, Section 18AA-10 (Municode), Oct 2026

Landlord rules

  • Gaithersburg will not issue or renew a rental license for a unit in a condominium, homeowners association or cooperative unless the owner certifies association fees are no more than 30 days past due.

For investors: Association arrears can block a buyer's license, so get a paid-assessments statement at settlement. The association may charge up to $25 for the certification, and a recorded lien or unpaid judgment it submits lets the city deny, suspend or revoke the license.

Source: Gaithersburg City Code, Section 18AA-7.1 (Municode), Oct 2026

  • Under Gaithersburg's Chapter 13, as amended by Ordinance O-7-24 on November 4, 2024, a landlord may raise rent only once in 12 months and only after 90 days' written notice.

For investors: The notice must show old and new rent, the percentage increase, the county's voluntary guideline and the tenant's right to ask the city housing department to review it. Buildings with 12 or more units must also send the notice to the city manager.

Source: Gaithersburg City Code, Section 13-20(e) (Municode), Oct 2026

Short-term rentals

  • A Gaithersburg short-term rental needs a one-year city license with a $500 application fee, and the licensee must be a permanent resident and/or owner who names an agent available at all times.

For investors: City Code treats a short-term rental as accessory and secondary to a home's household living use, so the license suits a lived-in house rather than a dedicated vacation unit. The agent may be a long-term renter and must handle complaints at any hour.

Source: City of Gaithersburg, Short-Term Rentals; City Code Section 18AA-2 (Municode), Oct 2026

  • A Gaithersburg short-term rental may not be booked for less than one night or for more than 120 days in total during each 365-day license term, and operating without a license brings a $500 fine.

For investors: With 120 nights as the ceiling, project short-term income on roughly a third of the year and plan for household use the rest. City Code also requires the license number on every listing, which makes unlicensed ads easy to spot.

Source: City of Gaithersburg, Short-Term Rentals; City Code Section 18AA-3.1 (Municode), Oct 2026

  • City Code requires each Gaithersburg short-term host to carry at least $1,000,000 of liability insurance naming the city as additional insured, keep a guest registry, and obtain any association's written approval.

For investors: Ask the insurer for a policy or endorsement listing the City of Gaithersburg before applying. The registry must show each guest's name, check-in and check-out dates and rent paid, and be ready for inspection, so keep platform exports organized.

Source: Gaithersburg City Code, Section 18AA-3.1 (Municode), Oct 2026

  • Gaithersburg allows one rental contract per short-term unit at a time and two adults per bedroom, bans parties and events, and requires one off-street parking space unless the listing prohibits guest vehicles.

For investors: A three-bedroom house tops out at six adult guests on a single booking, which limits group pricing. A townhouse without a driveway or assigned space needs a listing that tells guests not to bring a car.

Source: City of Gaithersburg, Short-Term Rentals, Oct 2026

  • Gaithersburg levies its own 2% hotel rental tax on transient stays under 30 days, and City Code counts short-term rentals as hotels, with reports and payment due by the last day of each month.

For investors: Collect the 2% from guests and file for the previous month's stays, keeping records for three years for city review. Matching each filing to platform payout reports makes an audit simple and keeps the short-term license in good standing.

Rent control and eviction rules

  • Montgomery County's rent stabilization law does not cover rental units inside Gaithersburg; the county directs Gaithersburg tenants to the city instead.

For investors: The county's 5.2% cap for July 2026 to June 2027 does not bind Gaithersburg leases, but the city's Chapter 13 sets its own notice rules and limits how often rent can rise. Compare both before pricing a purchase near the city line.

Rental inspections

  • Gaithersburg landlords must radon-test ground-contact and basement units in buildings of four or more units before leasing, using results under two years old, and give tenants the results with the lease.

For investors: If a tenant's test confirms 4 picocuries per liter or more, the landlord must mitigate within 90 days and pays for follow-up testing. Budget radon testing for the ground floor of any Gaithersburg building of four or more units.

What drives rental demand

  • The National Institute of Standards and Technology has its headquarters on a 578-acre campus in Gaithersburg, the larger of its two main sites alongside Boulder, Colorado.

For investors: A federal lab campus of this size keeps scientists, technicians and contractors looking for housing nearby. Because federal staffing can shift with budgets, avoid underwriting a Gaithersburg rental on growth at any single employer.

The payment shown is principal and interest, or interest only where an interest-only option was selected; interest-only payments do not reduce the loan balance and the payment increases when the interest-only period ends.
