Short-term rentals
Birmingham's proposed short-term rental ordinance was not yet law in October 2026; on September 30 the council's Committee of the Whole sent its licensing and enforcement rules to the full council for October 27.
For investors: Separate zoning rules on where rentals may operate and how closely they may cluster have no timeline, so a Birmingham buyer cannot yet know whether a given block will allow nightly guests. Price any short-term plan on long-term rent first.

Title 3A, Chapter 6 of Birmingham's General Code levies a 6.5% city lodging tax on rooms furnished to transients, plus an additional charge of $3.00 per room for each night.
For investors: The flat $3 bites hardest on cheap stays: on a $90 night it adds more than three points to the effective rate. The state's rate report lists this tax as administered by the city itself, so expect a City of Birmingham return, not just a state filing.

Alabama's October 2026 lodgings rate report lists Jefferson County's lodging tax at 7%, so a Birmingham stay carries 17.5% in general lodging taxes with the 4% state rate, plus the $3 nightly fee.
For investors: On a $150 night, 17.5% plus the $3 fee adds about $29 to the guest's bill before cleaning charges. Check which of the three levies your booking platform collects and which you must file yourself before the first guest arrives.
