Local Rules

Investing in Tallahassee: The Local Rules

Short-term rentals

  • Tallahassee's Growth Management office says the zoning code governs land use, not who occupies a home or for how long, so short-term rentals are allowed in residential zones.

For investors: Because the zoning code does not separate nightly stays from annual leases, the practical limits on a Tallahassee short-term rental are private ones such as HOA or condo covenants. Read the declaration before pricing a home on game-weekend demand.

Source: City of Tallahassee Growth Management FAQ: Are short term vacation rentals allowed?, Oct 2026

  • Leon County levies a 5% tourist development tax on houses, condos and other lodging rented for up to six months; the owner or agent collects it and remits it to the Leon County Tax Collector.

For investors: The tourist tax account sits with the county Tax Collector, while state sales tax on the same stay goes to the Department of Revenue. Open the Leon account before the first guest arrives and keep three years of records, as the Tax Collector requires.

Hazards and insurance

  • FEMA's October 2026 flood discount list shows Tallahassee at Class 5, a rating in effect since October 2022, worth a 25% reduction on National Flood Insurance Program premiums written in the city.

For investors: Tallahassee's class matches unincorporated Leon County's, so the discount will not separate city and county addresses. It lowers a premium but does not remove the federal flood coverage requirement on a financed building in a mapped A zone, so check the parcel's FEMA zone before making an offer.

ADUs and lot splits

  • Tallahassee allows one ADU per house or duplex lot, or one per duplex unit inside the Multi-Modal Transportation District, up to 1,200 square feet and two stories, with its own meter and address if wanted.

For investors: City guidance says an ADU may be rented short or long term and does not count toward density. On lots zoned RP-1, RP-2, R-1 or R-2, the code expressly applies its rooming house limits to lots with an ADU, so count unrelated occupants before leasing both units.

Source: City of Tallahassee Growth Management, Zoning Spotlight: Accessory Dwelling Units (March 2024), checked against Land Development Code Sec. 10-412, Oct 2026

  • Ordinance 25-O-26 lets Multi-Modal Transportation District homes and duplex units rent to four or more unrelated people if within a mile of a campus master plan boundary and a quarter mile of a transit stop.

For investors: Adopted November 19, 2025, it opens bedroom-by-bedroom leasing near the FSU and FAMU campuses, but lots zoned RP-1, RP-2, NB-1 or NBO and fraternity or sorority houses are excluded. Measure the distance to the nearest StarMetro stop and confirm zoning before paying a student-rental price.

Source: Tallahassee Land Development Code Sec. 10-280.7(d), as amended by Ord. No. 25-O-26 (Municode, Supp. 75), Oct 2026

Landlord rules

  • Tallahassee's code calls a house or duplex unit rented to four or more unrelated people a rooming house, barred in RP-1, RP-2, R-1 and R-2 zones unless grandfathered or campus-area exempt.

For investors: Before underwriting a by-the-bedroom student rental, look up the parcel's zoning on the city map. Rooming houses grandfathered by June 2001 registration must renew each year by March 31, pay double the fee if late, and can lose their status after citations on three separate occasions within six months.

Source: Tallahassee Land Development Code Sec. 1-2 (rooming house definition) and Sec. 10-83 (Municode, Supp. 75), Oct 2026

Flood zones

  • In Tallahassee's mapped flood hazard areas, new homes and substantial improvements must put the lowest floor at least two feet above base flood elevation, with mechanical equipment at least one foot above it.

For investors: The code counts work costing 50% or more of the building's pre-project market value as a substantial improvement, so a gut renovation of a flood-zone rental can force elevation. Order an elevation certificate and talk to the building division before setting a rehab budget.

Utilities

  • City of Tallahassee Utilities asks a $270 residential deposit for electric, water, sewer and natural gas together, plus $55.50 in connection charges, and spreads the deposit over the first three monthly bills.

For investors: The city itself sells the electricity, gas and water, so vacancy turn-ons between tenants go through one office at 435 N. Macomb St. or online. A letter showing a year of on-time payments elsewhere can waive the deposit, and good payers get it back as a credit after three years.

Tax calendar

  • For the 2026 tax roll, Leon County's Value Adjustment Board accepted assessment petitions from August 17 to September 11, with special magistrate hearings on set days from October 16 through November 13.

For investors: The Leon Property Appraiser mails TRIM notices in August and the petition window is 25 days, counted by when the board receives the filing, not the postmark. An owner who thinks a Tallahassee rental is overassessed should have comparable sales ready before the notice arrives.

What drives rental demand

  • Florida State University's housing office says it cannot house everyone who requests a room from its more than 40,000 students, and the university has no rule requiring students to live on campus.

For investors: Students who miss out on a campus room rent in town, which feeds the bedroom-by-bedroom market around FSU and along the transit corridors the 2025 occupancy ordinance targets. Expect leases timed to the academic year and plan turnovers for late summer.

Source: Florida State University, University Housing: About Us, Oct 2026

  • Florida's constitution makes Tallahassee the seat of government, where the legislature meets each year in a regular session limited to 60 consecutive days unless three-fifths of each house votes to extend it.

For investors: Session months bring legislators, staff, lobbyists and press to town, which supports furnished stays of a few months near downtown and the Capitol. Those stays still fall under Leon's tourist tax, which reaches any rental of six months or less, so price it in.

Investor Questions

Tallahassee Investor FAQ

Can I rent a Tallahassee house to four or more students?

Only in some places. Four or more unrelated tenants make a rooming house, barred in RP-1, RP-2, R-1 and R-2 zones unless grandfathered. Since November 2025, Multi-Modal Transportation District homes and duplex units within a mile of a campus master plan boundary and a quarter mile of a transit stop are exempt, except RP-1, RP-2, NB-1 and NBO lots.

Are nightly rentals allowed in Tallahassee, and what tax applies?

Yes. The city's zoning code does not regulate rental length, so short-term rentals are allowed. Stays up to six months owe Leon County's 5% tourist development tax, which the owner or agent collects and pays to the Leon County Tax Collector.

How large can a rentable ADU be in Tallahassee?

Up to 1,200 square feet and two stories, meeting the main house's setbacks and lot coverage. The city says an ADU may be rented short or long term, and it can have its own address and utility meter.

What does utility setup cost for a Tallahassee rental?

City of Tallahassee Utilities asks $270 in deposits for electric, water, sewer and gas together, plus $55.50 in connection charges. The deposit is billed across the first three bills and can be waived with a letter showing a year of good payment history with another utility.
