Local Rules

Investing in Santa Ana: The Local Rules

Short-term rentals

  • An Orange County judge in April 2026 ordered Santa Ana to set aside its 2024 ban on rentals under 30 days for skipping environmental review; the city may re-enact it after a CEQA analysis.

For investors: Do not underwrite a Santa Ana purchase on nightly income. The city can complete the review and adopt the ban again, and other claims in the lawsuit were still pending, so size any deal on long-term rent and treat guest revenue as temporary.

Rent control and eviction rules

  • Santa Ana's allowable rent increase is 2.87% for September 1, 2026 through August 31, 2027, which is 80% of the 3.59% May-to-May CPI change, since that falls below the 3% ceiling.

For investors: Covered Santa Ana units grow more slowly than the state cap would allow, so a five-year pro forma should use under 3% yearly growth on in-place tenants. Ask for each tenant's last increase date, since only one increase fits in any 12 months.

Source: City of Santa Ana, Rent Stabilization and Just Cause Eviction Ordinance, Sep 2026

  • Santa Ana's rent cap covers residential buildings built on or before February 1, 1995 and mobilehome parks established before 1990, with only one rent increase allowed in any 12-month period.

For investors: A 1980s Santa Ana fourplex is covered while a 2000s townhome rental is not, so the original construction date shapes value. Units exempt under state law sit outside the cap, but their owners still have to register and claim that exemption.

Source: City of Santa Ana, Rent Stabilization and Just Cause Eviction Ordinance, Oct 2026

  • Santa Ana landlords can petition for a capital improvement pass-through for work paid for and completed after November 19, 2021, or a fair return increase, with hearings held within 60 days of acceptance.

For investors: Keep invoices and proof of payment for every major repair, because a hearing officer rules on each petition and only work paid for and completed after November 19, 2021 counts. A rehab done after purchase is recoverable only if the petition is complete and approved.

Rental registration and inspection

  • Santa Ana's Rental Registry fee is $100 per unit if paid by July 31, 2026 and $104 after; the registration deadline was July 1, and late penalties start October 1.

For investors: Owners who register and pay on time may pass up to half the fee, $50 a unit, to tenants over 12 monthly installments, a right lost by registering after July 1. A buyer files the portal's new-owner workflow rather than editing the seller's account.

Source: City of Santa Ana, Santa Ana Rental Registry, Oct 2026

  • Exemptions from Santa Ana's ordinance are not permanent: an owner must file a claim each year by July 1, or the unit is treated as covered until the city approves the exemption.

For investors: Even a newer or otherwise exempt Santa Ana rental needs this annual filing, so add it to a June task list every year. Missing it exposes the owner to enforcement as though the unit were rent-capped until the claim is approved.

Landlord rules

  • A Santa Ana rent increase cannot take effect unless the unit meets city codes, repairs are finished and registration is accurate, and tenants must get written notice of their rights.

For investors: Open code cases at purchase can freeze rent growth on a Santa Ana building, so request the code enforcement history during escrow and clear items before noticing the first increase. Registration errors carry the same consequence, so audit the unit records too.

Source: City of Santa Ana, Allowable rent increase announcement 2026-27, Sep 2026

  • After 30 days, ending a Santa Ana tenancy requires a written just cause and, for at-fault cases, a prior chance to cure; the exemption for housing under 15 years old needs city approval.

For investors: Protection begins far earlier than the state's 12-month rule, so a short trial lease does not avoid it. A rental built in 2015 may qualify for the new-housing exemption, but only once the owner applies and is approved through the Rental Registry.

Source: City of Santa Ana, Rent Stabilization and Just Cause Eviction Ordinance, Oct 2026

  • For a no-fault termination in Santa Ana, the owner must pay three months of relocation assistance or waive the last three months' rent, and a market withdrawal must last at least 24 months.

For investors: Clearing a Santa Ana duplex for an owner move-in or a vacant sale costs about a quarter of a year's rent per unit. Factor that into any plan to buy occupied and deliver empty, and confirm the reason fits the ordinance's listed no-fault causes.

Property tax

  • Santa Ana spans four unified school districts, Santa Ana, Garden Grove, Orange and Tustin, whose fiscal 2025 bond rates ranged from about 0.024% to 0.061% on top of the 1% base levy.

For investors: Two Santa Ana rentals a mile apart can carry different tax bills because their school and community college bonds differ. Pull the actual tax rate area from the county bill for each address rather than using one citywide estimate.

What drives rental demand

  • The County of Orange is Santa Ana's largest employer, with 17,713 workers in 2025, about 11% of employment in the city, and the county Superior Court adds 745 more.

For investors: Public payrolls tend to hold steady in downturns, which steadies rental demand in Santa Ana. Long-tenure government tenants also mean slower turnover, so in-place rents on older capped buildings may sit well below market at purchase.

Source: City of Santa Ana, FY 2025 Annual Comprehensive Financial Report (statistical section), Jun 2025

  • Other leading Santa Ana employers in 2025 were Santa Ana Unified School District with 6,360 workers, Santa Ana College and its affiliates with 3,701, and Orange County Global Medical Center with 1,781.

For investors: Teachers, college staff and hospital shift workers form a large local renter pool for duplexes and small apartment buildings. Hospital staff in particular value short commutes, which helps leasing for units close to the medical center.

Investor Questions

Santa Ana Investor FAQ

Where do Santa Ana's nightly rental rules stand after the 2026 court ruling?

It is unsettled. A court set aside the city's 2024 ban on rentals under 30 days in April 2026 because the city skipped environmental review, and the city may re-enact it after that analysis, so short-term income is risky to count on.

How much can I raise rent on an older Santa Ana rental?

For buildings built on or before February 1, 1995, the cap is 2.87% for September 2026 through August 2027, once per 12 months, and the increase cannot take effect unless the unit is code-compliant, repaired and correctly registered.

Source: santa-ana.gov

What does the Santa Ana rental registry cost?

$100 per unit for the 2026-27 year if paid by July 31, 2026, then $104. The filing deadline was July 1, late penalties start October 1, and owners who pay on time may pass up to half the fee to tenants over 12 months.

What relocation does Santa Ana require for a no-fault eviction?

Three months of relocation assistance, or a waiver of the final three months' rent. Just cause applies once a tenant has been in place 30 days, and a withdrawal from the rental market must last at least 24 months.
