Local Rules

Investing in Hayward: The Local Rules

Rent control and eviction rules

  • Hayward's Rent Stabilization Ordinance allows one increase every 12 months of up to 5% on covered units, which broadly are multi-unit properties built before July 1, 1979.

For investors: Confirm the build year, and search the city's Rent Review Database, before offering on a Hayward apartment building. A 1978 fourplex carries the 5% cap and petition process, while a 1985 building on the same block follows only state rules.

  • Unused Hayward increases accrued since 2018 can be banked for up to 10 years, but the annual increase plus any banked amount may not exceed 10% of the tenant's current rent.

For investors: A unit whose rent sat flat under the seller may hold banked increases, but the landlord must hand the tenant a rental history when using them. Ask for ledgers going back to 2018 during due diligence, or the bank is hard to prove.

Landlord rules

  • Hayward landlords must send the city a copy of every rent increase notice and every termination notice, including cure or quit notices, within 30 calendar days of informing the tenant.

For investors: The filing duty reaches every Hayward rental, even a house exempt from the 5% cap. Copies go to 777 B Street or the city's rental notifications inbox, so add the step to the property manager's checklist for each notice served.

  • As amended in December 2024, Hayward's code says a landlord who displaces tenants 30 days or longer for permitted repairs owes a temporary relocation payment of three times HUD's Alameda County Fair Market Rent.

For investors: Price this into any Hayward rehab that empties units, such as replumbing or seismic work. Offering a comparable Hayward unit at the old rent, plus moving costs both ways, is the alternative, and proof of payment must reach the Rent Review Officer within seven days.

Rental registration and inspection

  • Hayward's FY 2026-27 schedule sets the rent stabilization fee at $32 per rental unit or $66 per covered unit, delinquent after October 31; putting unpaid fees on a parcel special assessment adds $921.

For investors: At the covered-unit rate, a pre-1979 Hayward fourplex is billed $264 a year for the rent program alone, before inspection fees. Pay by October 31, because unpaid bills can be placed on the parcel as a special assessment and follow the property.

Rental inspections

  • Hayward's FY 2026-27 fee schedule sets the annual rental housing inspection program fee at $125 for a single-family home through fourplex, or $35 per unit for buildings of five or more units.

For investors: An initial Hayward inspection with no violations is covered by that fee, but each re-inspection costs $784 for a single unit or $180 per unit in multifamily, and a missed access visit costs $512. Close out items before the follow-up date.

Transfer tax

  • Alameda County's recorder collects Hayward's city conveyance tax of $8.50 per $1,000 of full value in addition to the county's documentary transfer tax of $0.55 per $500.

For investors: On a $1.1 million Hayward fourplex the city tax is $9,350 and the county adds about $1,210. Who pays is a contract term, so settle the split before signing, and expect sellers to point at it in price talks.

Hazards and insurance

  • USGS measures the Hayward Fault creeping about one-fifth of an inch a year, visibly offsetting curbs in Hayward, and says it may be ready for another magnitude 6.8 to 7.0 quake like 1868's.

For investors: Slow creep can crack slabs and driveways on lots straddling the trace, so look for offsets when inspecting Hayward property near it. Most standard property policies exclude quake damage, so price separate earthquake cover into the rental budget.

Permits and occupancy

  • Hayward's 2019 screening law requires owners of pre-1978 buildings with three or more units to file a report, sealed by a California-licensed architect or civil engineer, on whether a weak wood-frame story exists.

For investors: Ask the seller of a pre-1978 Hayward triplex or larger for the screening filing, since the city keeps a public list of subject buildings. A sale never extends the filing deadline, and a weak-story finding is worth pricing as a future retrofit.

Short-term rentals

  • Hayward's FY 2026-27 fee schedule lists unauthorized short-term rentals among egregious code violations, with penalties of $1,500 for a first verified violation, $3,000 for a second and $5,000 after that.

For investors: Hayward lists an unapproved guest rental beside illegal garage conversions, and penalties climb with each verified finding. Plan a Hayward purchase around standard leases unless the city confirms a guest rental is allowed at that address.

Utilities

  • Hayward's utility users tax adds 5.5% to charges for electricity, gas, telephone and video service used in the city; water service is not on the taxed list.

For investors: Where a Hayward owner pays house meters or a master gas account, the 5.5% raises operating cost, and the tax runs to June 30, 2039 unless voters renew it. Tenants with their own gas and electric accounts pay it instead.

What drives rental demand

  • Hayward's FY 2024 financial report lists Hayward Unified, Cal State East Bay, Chabot College, Illumina, Baxter and the Alameda County Sheriff's Department among the city's principal employers.

For investors: Cal State East Bay and Chabot College bring students and staff who want rooms and small units near campus. Biotech employers such as Illumina and Baxter add salaried renters who look for short commutes inside Hayward.

Investor Questions

Hayward Investor FAQ

Which Hayward rentals fall under the 5% rent cap?

Mostly multi-unit properties built before July 1, 1979. Those units can rise once every 12 months by up to 5%, or 10% with banked increases. Houses and newer buildings are outside the cap, but rent increase and termination notices still go to the city.

Source: hayward-ca.gov

What annual city fees does a Hayward rental owner pay?

For FY 2026-27, the rent program fee is $32 per unit or $66 per covered unit, due by October 31. The inspection program adds $125 per property for one to four units, or $35 per unit for five or more.

Source: hayward-ca.gov

Does Hayward add its own transfer tax?

Yes. Hayward charges $8.50 per $1,000 of value, collected by the Alameda County recorder on top of the county's $0.55 per $500. On a $1.1 million building that is $9,350 to the city.

Source: alamedacountyca.gov

Do older Hayward apartment buildings need a seismic check?

Yes, if the building has three or more units and was built or permitted before 1978. The owner must file a screening report sealed by a California-licensed architect or civil engineer stating whether a weak wood-frame story exists. A sale does not extend the deadline.

Products shown are business-purpose investor loans (such as DSCR) secured by non-owner-occupied property. They are not consumer mortgages and are not intended for personal, family, or household use.

Estimates are based on the information you provide and assume it is accurate and complete. Actual terms depend on full underwriting, appraisal, title, and program eligibility and may differ. The rate shown is the note rate, not the APR; figures exclude taxes, insurance, and certain third-party costs. The payment shown is principal and interest, or interest only where an interest-only option was selected; interest-only payments do not reduce the loan balance and the payment increases when the interest-only period ends.
