Local Rules

Investing in Modesto: The Local Rules

Rental registration and inspection

  • Modesto's Rental Housing Safety Program, created by Ordinance 3703 in 2019, requires owners to register residential rental units, record a local contact and self-certify that units meet safety standards; registration is free.

For investors: Register each Modesto unit right after closing and name a local contact who can accept personally served city notices. With no fee, the real cost is the self-certification walk-through and whatever repairs it turns up.

Rental inspections

  • Each year Modesto audits up to 10% of rental units with city inspections, billing $100 per inspected unit; owners who never register are added to the registry as noncompliant and fined.

For investors: On a Modesto fourplex the city may draw some units at random, and each one inspected costs the owner $100. A unit does not pass until that fee is paid, so budget for it in any year the city selects the property.

  • Modesto mails notice at least two weeks before an audit inspection, accepts repairs made during the visit, and lets owners document fixes completed within 30 days on a free Proof of Correction form.

For investors: Two weeks is enough to arrange tenant access through the listed local contact. Fixes made on the spot or within 30 days can be documented at no charge, so keep a handyman on call during any Modesto audit week.

Short-term rentals

  • A Modesto vacation or short-term rental, such as an Airbnb or Vrbo listing, must hold a Transient Occupancy Registration Permit at all times while operating, under Municipal Code section 8-2.606.

For investors: Apply for the permit before a Modesto home goes live on Airbnb or Vrbo, since it must be in effect the whole time the rental operates. The application has its own residential vacation rental category, separate from hotels.

  • Modesto taxes guest stays of 27 consecutive days or less at 9% of rent, under Municipal Code sections 8-2.602 and 8-2.603.

For investors: Modesto treats a guest as a transient until 27 days pass unless a written agreement provides for a longer stay. Put monthly bookings for visiting medical staff or corporate travelers in writing from the first night, and price shorter stays with the 9% included.

Landlord rules

  • If the City of Modesto orders a rental vacated within 72 hours for unsafe or hazardous conditions, displaced tenants qualify for relocation benefits under Municipal Code Chapter 12, Article 5.

For investors: A neglected Modesto rental carries a hidden risk: conditions bad enough for a 72-hour vacate order displace the tenants and trigger the city's relocation program. Inspect older units closely before buying and fix life-safety items such as wiring and gas lines first.

Utilities

  • Modesto levies a 6% utility users tax on electricity, water, gas and telephone service, capped at $1,500 per separately metered service each calendar year; prepayments of the cap should be made by December 15.

For investors: When a Modesto landlord pays water or gas for a small apartment building, the 6% tax rides on those bills. A large master-metered account may reach the $1,500 cap, and prepaying it stops collection for the following year.

ADUs and lot splits

  • Stanislaus County and six cities, Modesto among them, developed seven free plans for detached ADUs, each with several exterior finish options; Modesto charges $197 to give a permitted ADU its own address.

For investors: A free shared plan trims design cost for a backyard unit on a Modesto rental lot. Apply for the separate address only after the building permit issues, which keeps utility setup and tenant mail clean for the new unit.

  • Modesto's ADU Express program offers a one-hour same-day plan review with city staff, and qualifying ADU or junior ADU plans from a professional designer or licensed architect or engineer can be approved there.

For investors: Same-day approval shortens the time a Modesto lot sits idle before construction on a second rentable unit. Bring complete, professionally prepared plans, since only those can win approval at the meeting.

Flood zones

  • A June 2022 Stanislaus County Public Works memo calls Tuolumne River flooding a continuing problem and Dry Creek an unregulated watershed feeding it; Modesto, the county and the Army Corps urged the study.

For investors: Rentals near the river or Dry Creek in Modesto deserve a parcel-level FEMA map check before purchase. A mapped flood zone brings required flood insurance on a financed property, which can change the debt coverage math on a strong rent roll.

What drives rental demand

  • Modesto's FY 2024-25 financial report lists Kaiser Permanente Modesto Medical Center, about 3,800 workers, as the largest employer, ahead of E&J Gallo at 3,700, Memorial Medical Center at 3,018 and Doctors Medical at 2,600.

For investors: Three hospitals among the five largest employers give Modesto a steady pool of healthcare renters on shift schedules. Rentals with easy access to those campuses can also draw furnished monthly stays from visiting medical staff.
