Local Rules

Investing in Detroit: The Local Rules

Rental registration and inspection

  • Detroit owners register each rental in BSEED's eLAPS Code Enforcement module; the Certificate of Rental Registration is free and stays valid until ownership or use changes, but registering alone does not make the home compliant.

For investors: The seller's registration expires at the sale, and the ordinance gives a buyer 90 days to file a new one. Registering is only step one: renting or collecting rent without a separate Certificate of Compliance is unlawful under the ordinance.

Rental inspections

Landlord rules

  • Detroit's amended rental ordinance replaced the upfront lead risk assessment with a visual paint and bare-soil check at every inspection; a failure means repairs, then a re-inspection with dust wipes where state law allows.

For investors: Homes built after January 1, 1978, homes fully abated with a passed clearance exam, and homes a certified inspector found lead-free skip these lead steps. In the city's designated high-risk areas, inspections also take dust wipes where state law permits. Repaint chipping surfaces first.

Source: City of Detroit, Final Rental Ordinance as passed October 29, 2024, Sec. 8-15-82(f) (Chapter 8, Article XV, Division 3), Oct 2024

  • Detroit's October 2024 rental ordinance amendments require a tenant escrow program run by the Housing and Revitalization Department, open to tenants whose home lacks a Certificate of Compliance or has documented safety violations.

For investors: The department reviews each escrow account at least every 120 days: if you hold a certificate or have fixed the violations by then, the rent goes to you, and if not, it goes back to the tenant. Rent paid on time into escrow does not breach the lease.

Source: City of Detroit, Detroit Rental Escrow Program; Final Rental Ordinance Sec. 8-15-86 (tenant escrow), Oct 2026

  • Detroit's ordinance sets first-offense fines of $400 for an unregistered rental or one without a Certificate of Compliance, rising to $1,150 for a third certificate offense; unpaid fines can become liens enforced like delinquent taxes.

For investors: Once the violation is fixed, a hearing officer can cut a registration or certificate fine by up to 50 percent, so repairs pay off. Pull the parcel's blight ticket history before closing, since a recorded fine lien stays with the property.

Tax calendar

  • Detroit summer property taxes are due in full by August 31, or in halves by August 15 and January 15; winter taxes are due January 15; late winter balances accrue interest back to December 1.

For investors: Any summer balance unpaid after the due date draws penalty and interest from July 1, and on March 1 delinquent bills transfer to the Wayne County Treasurer. If a servicer escrows your taxes, confirm it pays the summer bill by August 31.

Market note

Utilities

  • DWSD's Landlord-Tenant Agreement moves a Detroit water and sewerage account from the landlord to the tenant, whose application needs a lease assigning water responsibility; only the authorized account holder can request a turn-off.

For investors: Write the water clause into every Detroit lease, since the tenant must show it to open an account, and DWSD also posts an Affidavit of Lessee Responsibility form. At move-out, the tenant vacating form or the portal's Move Out option requests the closing meter read.

Flood zones

  • FEMA's community status data lists Detroit at Community Rating System class 7 since April 1, 2024, worth 15% off NFIP flood policies in Special Flood Hazard Areas and 5% elsewhere (map effective October 2021).

For investors: Check the parcel on FEMA's current map, since a federally backed loan requires flood coverage inside a Special Flood Hazard Area and the discount applies only to NFIP policies on properties within the city limits. Private flood quotes do not carry the CRS credit.

What drives rental demand

  • Henry Ford Health, headquartered in Detroit for more than a century, says 50,000 team members work at its more than 550 sites across Michigan.

For investors: The headcount is the system's own statewide figure. Its flagship hospital on West Grand Boulevard sits near Wayne State University and the Detroit Medical Center, so New Center, Midtown and Woodbridge rentals draw clinicians, residents and students.

Investor Questions

Detroit Investor FAQ

What do I need before renting out a house I buy in Detroit?

Register the property in BSEED's eLAPS portal, then pass the 15-point condition inspection, through the company assigned to your ZIP code for a 1-2 unit home or with BSEED for 3 or more units. BSEED then issues a three-year Certificate of Compliance; a passed Section 8 or MSHDA inspection under 12 months old can be uploaded instead.

What happens if my Detroit rental has no Certificate of Compliance?

Tenants may pay rent into the city's escrow program instead of to you. At each review, at least every 120 days, the money goes to you if the home is certified or fixed and back to the tenant if not. Fines start at $400, and unpaid fines can become liens enforced like delinquent taxes.

Do I owe Detroit income tax on rental income if I live outside the city?

Michigan's City Income Tax Act applies the nonresident tax to net profits from rentals of real property located in the city. Detroit's nonresident rate is 1.2%, against 2.4% for residents, and the Michigan Department of Treasury processes Detroit individual returns.

Which dates do Detroit's summer and winter tax bills carry?

Summer taxes are due in full by August 31, or in two halves by August 15 and January 15. Winter taxes are due January 15. Late balances accrue penalty and interest, and delinquent accounts transfer to the Wayne County Treasurer on March 1.

Products shown are business-purpose investor loans (such as DSCR) secured by non-owner-occupied property. They are not consumer mortgages and are not intended for personal, family, or household use.

Estimates are based on the information you provide and assume it is accurate and complete. Actual terms depend on full underwriting, appraisal, title, and program eligibility and may differ. The rate shown is the note rate, not the APR; figures exclude taxes, insurance, and certain third-party costs. The payment shown is principal and interest, or interest only where an interest-only option was selected; interest-only payments do not reduce the loan balance and the payment increases when the interest-only period ends.

Compensation and fees vary by loan amount, program, and transaction and are finalized in your loan documents at closing.
