Local Rules

Investing in Concord: The Local Rules

Rent control and eviction rules

  • Concord adopted rent stabilization and stronger just-cause eviction rules effective April 19, 2024; for covered units the allowable annual increase is 5% as of August 1, 2025.

For investors: On a pre-1995 Concord apartment building, model yearly increases at no more than the city's 5% cap, which replaced an older formula tied to inflation and sits below the statewide ceiling in most years. Value the building on that limit, not on market rent jumps.

Source: City of Concord Rent Program, Aug 2025

  • Concord's rent cap covers rented complexes of two or more units built before February 1, 1995; rented single-family homes, condos, ADUs and newer complexes fall outside it.

For investors: The build date decides your upside in Concord. A 1990 duplex is held to the city's 5% a year, while a 1996 fourplex or a rented house falls outside the city cap, though state limits can still apply. Pull the certificate of occupancy date before writing an offer.

Landlord rules

  • Since May 22, 2025, Concord's just-cause eviction rules apply to rented houses and condos only when the landlord owns three or more of them in the city; owners of one or two are exempt.

For investors: Owning one or two rented Concord houses keeps you outside the city's just-cause rules, though state law may still apply. Buying a third brings every rented house you own in Concord under the ordinance, so count that cost before expanding.

Source: City of Concord Rent Program, Oct 2026

  • For no-fault terminations, Concord requires three months of HUD fair market rent plus a $3,000 moving stipend for covered apartments, and two months' rent plus $2,000 from owners of three or more rented houses.

For investors: Budget these payments into any value-add plan for an older Concord building. Half the relocation payment is due within 15 calendar days of the notice and the rest by move-out, and a senior, disabled or lower-income tenant adds another month of fair market rent.

Rental registration and inspection

  • Nearly every Concord rental, including a single rented house or condo, must register yearly in the city's Rent Registry, and landlords must upload any termination notice to the registry portal within seven calendar days.

For investors: Add the registry to your Concord closing checklist. The city mails a letter with an account number and PIN, anyone can search a property's registration status online, and every notice you serve needs a seven-day upload on your calendar.

Source: City of Concord, Residential Rent Registry Program, Oct 2026

  • Concord's 2025-26 registry fees are $78 per fully covered unit, $50 per partially covered unit and $33 per registry-only unit; houses and condos register in February and March, apartments in May and June.

For investors: A registry-only house costs $33 a year, while a covered pre-1995 fourplex runs $312, small next to the relocation exposure. The city sets fees each fiscal year, so confirm the current schedule when you underwrite holding costs.

Rental inspections

  • Concord's Multi-Family Inspection Program covers every rental building with four or more units on a parcel, with city building inspectors checking units and common areas on a two-year cycle.

For investors: A fourplex or larger in Concord will see a city inspector inside the units every two years, so deferred maintenance turns into correction orders. Inspect against building and housing codes before closing and price repairs into your offer.

Short-term rentals

  • Concord's transient occupancy tax is 10% of rent; rent from a guest staying 31 or more consecutive days is deductible from day 31 on, and operators file returns by the end of the following month.

For investors: Price a furnished Concord stay with the 10% added for the first 30 nights. Rent from day 31 on is deductible, so a furnished lease of a month or more to a traveling nurse or contractor carries a lighter tax load than nightly bookings.

Flood zones

  • Concord holds a Class 7 rating in FEMA's Community Rating System as of June 2024, which gives flood insurance policyholders in the city a 15% premium discount.

For investors: If a Concord rental sits in a mapped flood zone, the discount trims a policy your lender may require. Look up the parcel on the city's online flood map before bidding, and note that FEMA paused fill-based map revisions in Concord in 2023.

Hazards and insurance

  • On May 21, 2026 the California Geological Survey released preliminary Alquist-Priolo earthquake fault zones for the Concord fault zone, and the proposed maps reach into the City of Concord.

For investors: Once final, homes inside a fault zone carry a disclosure duty at sale, and new construction there can require a geologic study. Check the preliminary map before buying, since a zone label can affect resale and the cost of adding units.

ADUs and lot splits

  • Concord offers free pre-approved ADU plans; with a complete submittal, plan review covers only the site plan, takes about five business days and is billed at hourly rates.

For investors: A backyard ADU on a Concord rental house is attractive because rented ADUs sit outside the city's rent cap, just-cause rules and registry. The free plans cut design cost and approval time, leaving construction as the main budget line.

What drives rental demand

  • The U.S. Navy has approved the term sheet for the Concord Community Reuse Project, the planned redevelopment of 2,422 acres at the former Concord Naval Weapons Station.

For investors: This is a multi-decade build that should add homes and jobs on Concord's east side. Nearby rentals could gain from new roads and employers over time, but a large wave of new housing may also compete for tenants, so do not price it in near term.
