Rent control and eviction rules
Rent increases on units covered by Oakland's Rent Adjustment Ordinance are limited to 2.3% for the year starting August 1, 2026.
For investors: With a CPI figure this small, in-place rents on an older Oakland building lag the market for long-tenured tenants. A new lease sets its own starting rent, but its first increase cannot take effect until 12 months after move-in, so model flat year-one rent.

An Oakland owner may raise a covered unit's rent only once in 12 months, with at least 30 days' written notice, and since April 15, 2025 not at all while delinquent on city business taxes.
For investors: After closing on an Oakland rental, set up the new owner's business tax account promptly, because a rent increase notice must carry a current certificate, or a city payment plan for a CPI-only raise. A fixed-term lease delays the increase until the term ends unless it allows one.

Oakland caps any single banked increase at three times the current CPI figure, 6.9% for August 2026 through July 2027, and since January 1, 2026 unused increases expire after five years.
For investors: A seller's long record of skipped increases cannot be cashed in at once after an Oakland purchase. Model banked raises in steps no larger than 6.9% a year, and ask for a full rent history, because banked amounts older than five years are lost.

Oakland exempts units built from the ground up in the past 10 years from its rent and just-cause ordinances, proven by a certificate of occupancy issued after April 1, 2013 or a RAP exemption certificate.
For investors: A ground-up Oakland building with a qualifying certificate sits outside both ordinances and the per-unit RAP fee. A unit converted from existing residential space does not qualify, so check the permit history behind the certificate before paying for that status.
