Local Rules

Investing in Overland Park: The Local Rules

Rental registration and inspection

Short-term rentals

Landlord rules

  • Overland Park's 2022 nuisance party ordinance makes it unlawful for an owner or anyone entitled to possess residential property to cause or permit a gathering of five or more to become a nuisance party.

For investors: Triggers include unlawful alcohol, Chapter 7.08 noise violations, assaults, property damage, littering, blocked streets, fireworks or gunfire. The code counts failing to exercise control as permitting, and a party still going an hour after a police dispersal order is a separate violation.

Source: Overland Park Municipal Code Secs. 11.28.105 to 11.28.108, Nuisance Parties (Ord. POC-3385, 2022), Oct 2026

Property tax

  • On the 2025 levy funding its 2026 budget, Overland Park charges 14.540 city mills, which it ranks lowest in Johnson County; county (17.290), community college (7.873) and school district (50.886 to 66.803) mills weigh more.

For investors: The school district moves the bill most: Shawnee Mission at 50.886 mills versus Spring Hill at 66.803. Add county parks (3.023), library (3.817) and the 1.500 state levy, all on 11.5% of appraised value; the city's example puts a $500,000 home between $3,359 and $4,086.

Source: City of Overland Park, Sales and Property Taxes ("2025 Mills for 2026 Budget" table and tax example), Oct 2026

Tax calendar

  • Johnson County mails first-installment real estate notices in mid-November and second notices in early April; the first half or full year is due December 20, the second half May 10, with interest afterward.

For investors: On a fall closing, settle at the title table who pays the December 20 half, since the county says a statement that never arrives does not excuse late interest. An owner contesting the tax pays under protest between November 1 and December 20, or by January 31 when escrow pays.

Hazards and insurance

  • FEMA rates Overland Park (NFIP community 200174) Community Rating System Class 7, effective since May 1, 2015, a 15% discount on eligible flood policies; the city says about 7% of its land is FEMA floodplain.

For investors: The city counts more than 400 buildings in the floodplain, some in older neighborhoods, so pull the parcel on the city's floodplain map before writing an offer. For a house in a mapped zone, price the flood policy with the 15% discount and allow for the 30-day waiting period.

Flood zones

  • Grading, filling, construction or home modifications inside an Overland Park floodplain need a $15 floodplain development permit, and the city asks that flood-damaged homes be inspected by city staff and the insurer before repairs.

For investors: A creek-side rehab may need both the floodplain permit and a building permit; the city requires the structure elevated, urges raising the furnace, water heater and panel, and advises against finished basements. StormWatch gauges show live levels on Indian Creek and Tomahawk Creek.

Permits and occupancy

  • Overland Park prices remodel and repair permits by project value: $30 under $5,000, $50 from $5,000 to $19,000, and 0.005 times the valuation above that; contractors are licensed through Johnson County rather than the city.

For investors: A $40,000 kitchen and bath turnover permits for about $200, so permit cost is rarely the reason to skip one here. Water tap fees come from WaterOne and sewer connection fees from Johnson County Wastewater, two separate bills to request when converting or adding units.

Utilities

  • Overland Park runs no utility or trash service: WaterOne supplies water, Johnson County Wastewater handles sewer, Evergy supplies power, Kansas Gas Service or Atmos supplies gas, and each owner hires a city-permitted private trash hauler.

For investors: Nothing comes bundled on a city bill, so a lease should spell out who holds the WaterOne, Evergy and gas accounts and who pays the permitted hauler. The city reviews hauler insurance and inspects trucks yearly, and runs a drop-off recycling center near 119th and Hardy.

What drives rental demand

Market note

  • Overland Park backs redevelopment with tax increment financing at Brookridge (103rd and Antioch), Metcalf 108 (I-435 and Metcalf), downtown's Avenue 80 and Edison District, plus sales-tax districts at Bluhawk (159th and U.S. 69).

For investors: Tax increment financing pledges a district's future property tax growth to pay for redevelopment, so these areas show where the city is steering reinvestment. Their added sales taxes, up to two cents in the Edison District, fall on shoppers rather than on nearby rental owners.

Investor Questions

Overland Park Investor FAQ

Do I need a license to rent out a house in Overland Park, and what does it cost?

Yes. Every rental home needs a city rental license: $120 per building, valid two years, issued after an exterior inspection and renewed through ePLACE. A license does not transfer with a sale, so a buyer must apply within 30 days of taking title, and the seller must disclose any open code orders.

Source: codes.opkansas.org

Which license covers a short-term visitor rental in Overland Park?

The city's licensing page says short-term rentals need the same rental license as any other rental property, and Chapter 5.75 sets no separate short-term permit or night cap. Under the 2022 nuisance party ordinance, an owner or occupant who causes or permits a gathering of five or more to become a nuisance party breaks the law.

Source: opkansas.gov

What property taxes will an Overland Park rental pay, and when?

On the 2025 levy funding the 2026 budget, the city charges 14.540 mills, which it calls the lowest in Johnson County, while the county (17.290), community college (7.873), state (1.500) and school district (50.886 to 66.803) make up most of the bill, applied to 11.5% of appraised value. Halves are due December 20 and May 10.

Is flood insurance discounted for a house in Overland Park?

Yes. Overland Park has been Community Rating System Class 7 since 2015, which cuts eligible NFIP premiums by 15%. About 7% of the city's land and more than 400 buildings sit in a FEMA floodplain, and any grading, filling or construction there needs a $15 floodplain development permit.
