Local Rules

Investing in Brownsville: The Local Rules

Short-term rentals

  • Brownsville's Short-Term Rental Ordinance, No. 2024-1760 adopted November 12, 2024, requires a city registration and permit before advertising or renting any home, room or accessory unit for 30 days or less.

For investors: The ordinance covers existing and future rentals alike, so an active Brownsville listing bought from a seller is not exempt. Owners must report changed application details within 30 days, so file updated ownership information right after closing.

Source: Brownsville Code of Ordinances, Ch. 94 Art. IV-A, Short Term Rental Registration (Ord. No. 2024-1760), Oct 2026

  • Brownsville's master fee schedule lists the short-term rental permit at $50; each permit expires a year after it takes effect and can be renewed from 30 days before to 30 days after expiration.

For investors: At $50 the permit is a minor cost; the real exposure is a lapse. Listings must carry the permit number, so an expired Brownsville permit leaves an advertised rental out of compliance until it is renewed.

Source: Brownsville Code of Ordinances, Sec. 2-434 Master Fee Schedule (CVB permits), Oct 2026

  • Each Brownsville short-term rental must name a local contact available around the clock who can respond in person within one hour, and its permit number must appear in every online or print listing.

For investors: An out-of-town owner needs a manager close enough to reach the property within the hour at any time of night. The application also asks for the Cameron Appraisal District property ID, the bedroom count and occupancy limits, so gather those first.

Source: Brownsville Code of Ordinances, Ch. 94 Art. IV-A, Short Term Rental Registration (Ord. No. 2024-1760), Oct 2026

  • Brownsville STR penalties start with a warning, fines up to $250 for a second violation within a year and up to $500 after, each day separate; a third violation in a permit year risks revocation.

For investors: Repeated noise or parking complaints add up fast when every day is a new offense. Owners who owe the city hotel tax or utility charges cannot register until the balance is paid, so clear any arrears on a purchased property early.

Source: Brownsville Code of Ordinances, Ch. 94 Art. IV-A, Short Term Rental Registration (Ord. No. 2024-1760), Oct 2026

  • Brownsville's code levies a 7% city hotel occupancy tax on rooms renting for $2 or more a day, with the report and payment due by the last day of the month after each monthly period.

For investors: Add the city's 7% to state hotel tax when pricing Brownsville stays. A city collection suit adds a 15% penalty plus attorney fees to unpaid tax, so automate monthly filings from the first booking rather than catching up later.

ADUs and lot splits

  • Where Brownsville zoning permits an accessory dwelling, the code allows one per lot, occupied by one household, rentable, no larger than half the main home's living space, and eligible for its own meter.

For investors: A backyard unit can add a second rent check on a Brownsville lot, and a separate meter lets that tenant carry utilities. Check the permitted use chart for the lot's district first; the STR ordinance treats an owner-occupied lot's nightly ADU as its own category.

Property tax

  • The City of Brownsville's adopted tax rate is $0.603504 per $100 for both 2025 and 2026, split in 2026 into $0.353581 for operations and $0.249923 for debt service.

For investors: A flat rate is not a flat bill: the city levy on a Brownsville rental still rises with its appraisal. About 41% of the city rate pays debt service, so bond elections shape future rates as much as operating budgets do.

Source: Cameron Appraisal District, 2026 Adopted Tax Rates, Oct 2026

  • Other 2026 rates on many Brownsville parcels include $0.424393 per $100 for Cameron County, $0.7716 for Brownsville ISD, $0.099734 for Texas Southmost College and $0.025589 for the Brownsville Navigation District.

For investors: Together with the city, those five levies come to about $1.92 per $100, roughly $3,850 a year on a $200,000 Brownsville rental before exemptions. Check the parcel record for South Texas ISD, drainage and other district lines.

  • The Cameron County Tax Assessor-Collector at 835 East Levee Street in Brownsville collects for the city, Brownsville ISD, the Navigation District, Texas Southmost College and the county drainage districts.

For investors: One county bill covers the main Brownsville levies, which keeps escrow simple. The appraisal district in San Benito sets values but collects nothing, so value protests go there and payments go to the county office on Levee Street.

Hazards and insurance

  • Brownsville is in Cameron County, one of 14 first-tier coastal counties where the Texas Windstorm Insurance Association writes wind and hail policies, which generally require a WPI-8 or similar code certificate.

For investors: TWIA is the fallback after a private insurer declines wind coverage, and it needs a WPI-8 or similar certificate. Ask the seller for it before closing on a Brownsville rental, since an unpermitted addition may not certify and could stall the purchase.

Source: Texas Windstorm Insurance Association, Coverage Eligibility, Oct 2026

  • For TWIA wind coverage, buildings in coastal V flood zones built or substantially altered on or after September 1, 2009 must also carry flood insurance when NFIP coverage is available.

For investors: Pull the FEMA flood zone for any Brownsville rental before binding wind coverage. If it shows a V zone and the house was built or remodeled after September 2009, budget both wind and flood premiums before setting rents.

What drives rental demand

  • The Texas governor's office announced on July 16, 2026 that Saronic Technologies will build its Port Alpha shipyard at the Port of Brownsville, a $3.248 billion investment expected to create 10,000 jobs.

For investors: A hiring program that size would draw welders, engineers and their families to Brownsville over several years. Rentals with short drives to the port could see firmer demand, but treat the job count as a projection until hiring begins.
