Local Rules

Investing in Fremont: The Local Rules

Rent control and eviction rules

  • Fremont's Rent Review Ordinance covers every rental, single-family homes included; tenants can seek review of increases above 5% in 12 months within 15 days, but the board's ruling is advisory, not binding.

For investors: Even one rented Fremont house is covered, so resetting a below-market rent after purchase can draw a review. The board cannot force a cut, but if review outlasts the notice period the tenant deposits only half the increase until it ends.

Landlord rules

  • Every Fremont rent increase notice, of any size, must include the city's rent review notice, and an increase above 5% must also state its reason; a notice missing these steps is void.

For investors: Attach the city's notice text to every Fremont increase, even a 3% one, or the increase fails. The city also encourages 90 days' notice, which leaves room for any review to finish before the new rent takes effect.

Source: Fremont Municipal Code Chapter 9.60 (Rent Review), Oct 2026

  • Once a Fremont tenant asks for review, the landlord or a named responsible party must answer the city's service provider within two business days; silence or bad-faith participation voids the increase.

For investors: Remote owners should appoint a Fremont responsible party, such as a property manager with authority to settle rent, and file the declaration. Skipping a board hearing also blocks any new increase notice for 90 days.

Rental registration and inspection

  • Fremont Sec. 9.60.130 bills landlords owning five or more rental units an annual per-unit fee, set yearly by council resolution to recover the rent review program's full cost and due within 45 days of billing.

For investors: A fourplex owner pays nothing, while a buyer whose Fremont holdings reach five units starts receiving invoices. Late bills fall under the city's business tax penalty rules in Chapter 5.05, so pay inside the 45-day window.

Source: Fremont Municipal Code Chapter 9.60 (Rent Review), Sec. 9.60.130, Oct 2026

  • Fremont's business tax (Sec. 5.05.310) charges rental owners $1.30 per $1,000 of gross receipts, but people renting no more than four residential units are not treated as being in business.

For investors: The same five-unit line governs both Fremont charges, so a fourplex investor avoids the business tax and the rent review fee. Crossing to five units anywhere in the city adds $1.30 for every $1,000 of rent collected each year.

Short-term rentals

  • Fremont's 2024 short-term rental ordinance requires a city permit and allows hosting only in the host's primary residence, never in an ADU, junior ADU or SB 9 unit, with one rental per host.

For investors: Fremont rules out buying a house or ADU purely for guest stays, so an investment purchase there should be underwritten on 30-day-plus leases. Hosts must prove residence with two documents, such as a driver's license and a property tax bill.

Source: Fremont Municipal Code Chapter 5.100 (Short-Term Rentals), Jan 2024

  • Permitted Fremont hosts must cap guests at two per bedroom, carry $1,000,000 in liability coverage, name a local contact who responds in person within 60 minutes, and notify neighbors within 100 feet.

For investors: These rules apply even to an owner renting a room in a Fremont home they live in. Health or safety infractions carry fines up to $1,500, then $3,000, then $5,000 for repeats within a year, and permits cannot be transferred.

Source: Fremont Municipal Code Chapter 5.100 (Short-Term Rentals), Jan 2024

  • Fremont's transient occupancy tax is 10% of rent on stays of 30 consecutive days or less, reported monthly; late remittances add 10% a month, capped at 50%, plus 1% monthly interest.

For investors: A Fremont host should collect the 10% on every booking and file by the last day of the following month. Late filings get expensive fast, since penalties can add half the tax again before interest.

Transfer tax

  • Alameda County charges $0.55 per $500 on Fremont deeds, and Fremont is not among the county cities adding a conveyance tax; nearby Hayward adds $8.50 per $1,000 and Oakland up to $25.

For investors: On a $1.2 million Fremont fourplex the county tax is about $1,320, while the same price in Hayward would add $10,200 in city tax. That gap is worth noting when comparing southern Alameda County buys.

Hazards and insurance

  • The 1868 magnitude 6.8 Hayward Fault quake cracked the ground for about 20 miles, from Fremont's Warm Springs north to San Leandro; USGS says a repeat could cause losses topping $100 billion, mostly uninsured.

For investors: Standard property policies on a Fremont rental exclude earthquake damage, so decide whether to buy separate quake cover and price it into the DSCR math. Older wood-frame rentals near the fault trace may merit a structural review before purchase.

Utilities

  • Union Sanitary District, which serves Fremont, Newark and Union City, collects its annual sewer service charge on the Alameda County property tax roll, listed as Union Sewer Svc.

For investors: Fremont rental owners pay sewer through the tax bill rather than a monthly statement, so it flows through any tax impound. The district adopted new rates for FY 2026 through 2030, so check the current bill line rather than an old one.

What drives rental demand

  • Washington Health in Fremont runs a 415-bed acute care hospital with a Level II trauma center, opened in 1958 and governed by the elected Washington Township Health Care District board.

For investors: A trauma center staffs around the clock, which means nurses, technicians and support staff on rotating shifts looking for nearby rentals. Fremont units with short drives to the hospital can appeal to medical renters who value commute time.

Investor Questions

Fremont Investor FAQ

Can Fremont landlords raise rent more than 5%?

Yes, but a tenant can request review within 15 days, and the notice must state a reason. The Rent Review Board's ruling is advisory unless both sides sign it, so Fremont's own ordinance sets no binding cap, though state limits can still apply.

Can a Fremont investor host guests in an ADU or a house they do not live in?

No. Chapter 5.100 limits short-term rentals to the host's primary residence and bars them in ADUs, junior ADUs and SB 9 units. Each host may hold only one short-term rental in the city.

Which Fremont landlords pay the rent review fee?

Landlords with five or more residential rental units in Fremont. The council sets the per-unit amount each year to recover the program's full cost, the bill is due within 45 days, and owners of fewer than five units are exempt.

Does a Fremont purchase owe a city transfer tax?

No city tax is added. Fremont deeds pay only Alameda County's $0.55 per $500, unlike nearby Hayward, which adds $8.50 per $1,000, or Oakland, which adds $10 to $25 per $1,000.

California Rules Investors Ask About

Transfer tax

California counties may charge a documentary transfer tax of $0.55 per $500 of value ($1.10 per $1,000), and a city inside that county may add half that rate.
