Local Rules

Investing in Durham: The Local Rules

Property tax

Tax calendar

  • Durham County accepts installment payments on real property tax bills without a formal plan until January 5; delinquent bills then accrue 2% interest the first month and 0.75% monthly after that.

For investors: Make sure a Durham rental's bill is paid in full by January 5, because the county says a payment plan does not keep an account off its newspaper list of delinquent owners. The county does not sell tax liens either, so collection stays with the county itself.

Source: Durham County Tax Administration, Billing and Collections FAQs, Oct 2026

  • Durham County levies a 6% room occupancy tax on lodging rentals, with returns due by the 20th of the following month; stays of 90 or more consecutive days by one guest are exempt.

For investors: A furnished Durham unit leased to the same traveling nurse for 90 consecutive days or more falls outside this tax, but shorter bookings do not. A missed monthly return draws a 5% penalty for each month late, capped at 25%, so calendar the filing date.

Short-term rentals

  • Durham's UDO describes household living as occupancy on a month-to-month or longer basis; its Overnight Accommodations category, listing hotels, motels, inns, extended-stay facilities and bed and breakfasts, covers units rented for stays under 30 days.

For investors: Stays shorter than a month fall outside the household living description, so ask the Durham City-County Planning Department how it would classify a specific house before counting on nightly income. The UDO website also notes an upcoming New UDO rewrite, so recheck before closing.

ADUs and lot splits

  • Durham allows one accessory dwelling on a lot with one or two homes, up to 1,000 heated square feet on one story and 1,200 total outside the RR district, but none in flood hazard areas.

For investors: No parking space is required, and a duplex lot can still take an accessory unit, giving three rentals on one Durham parcel. If the main house is single-family, the accessory building may itself be a duplex if both units stay within 1,200 heated square feet.

Source: Durham Unified Development Ordinance, Sec. 5.4.2 Accessory Dwellings, Oct 2026

  • Durham's UDO lists the duplex as a permitted housing type in every RS and RU residential district, and district density caps do not apply to a two-family project needing no subdivision or site plan.

For investors: On an RS-10 or RU-5 lot a duplex needs no rezoning, though it must still meet the lot dimensions and yards that Sec. 7.1 sets for the duplex housing type. Confirm the parcel's district on the city-county map before pricing a conversion.

Rental inspections

  • Durham's city code places a rental building in periodic housing inspections after three or more verified code violations within 12 months, a substandard-conditions complaint, or violations visible from outside.

For investors: Durham repealed its rental registration division in 2016 but kept this inspection program, and a single substandard-conditions complaint pulls in the entire building. Ask sellers for open housing code notices and fix exterior defects early, since violations seen from the street also count.

Flood zones

  • FEMA's October 1, 2026 Community Rating System list places the City of Durham in Class 7, a 15% flood insurance discount, while Durham County's separate listing sits in Class 8.

For investors: The city's Class 7 rating has been in effect since October 2019. A parcel outside the city line may be rated under the county's smaller discount, so confirm the community named on the flood quote along with the flood zone before committing.

Utilities

  • Durham's city code makes the property owner ultimately responsible for stormwater charges a billed tenant leaves unpaid, and lets the city back-bill a misbilled property for up to three years.

For investors: Stormwater can ride on a tenant's water and sewer bill, and unpaid charges can lead to water shutoff at the property. Check account status at each turnover, and note that triplexes and larger buildings fall in a different billing class from houses and duplexes.

What drives rental demand

  • Duke counted 48,313 full- and part-time employees across the university and its health system in July 2025, and enrolled 17,325 undergraduate, graduate and professional students in fall 2025.

For investors: Duke's hospital staff, researchers and 10,800 graduate and professional students support year-round demand near its Durham campuses. Lease terms timed to the academic year or to medical residency start dates can shorten gaps between tenants.

  • Research Triangle Park, founded in 1959 between three research universities, spans 7,000 acres and lists more than 385 companies, including science and technology firms, government agencies and startups.

For investors: The park widens a Durham landlord's tenant pool beyond Duke to lab, tech and agency staff. Compare commute times to the park and to Duke when choosing between Durham neighborhoods, since the two job centers pull renters in different directions.
