Local Rules

Investing in Fontana: The Local Rules

ADUs and lot splits

  • Fontana posts AB 1332 pre-approved detached ADU plans of 462, 738 and 1,143 square feet, one to three bedrooms, already checked against local zoning and building codes but still needing site details and a permit.

For investors: A Fontana investor adding a 738-square-foot two-bedroom behind a rental can skip much of the custom design spend. Confirm the lot's setbacks fit the plan footprint first, because the pre-approval covers the building, not your parcel.

Source: City of Fontana Building and Safety, Standard ADU Plans, Oct 2026

  • Fontana Sec. 30-467 bars renting any ADU or junior ADU for under 30 days, however old the unit, and lets an ADU be rented but not sold apart from the main house.

For investors: Underwrite a Fontana ADU as a monthly rental only; a guest-stay plan would break the code even on an older unit. Because it cannot be split off and sold, its value arrives as rent supporting the combined property's DSCR.

Source: Fontana Zoning and Development Code Sec. 30-467, Oct 2026

  • Fontana Sec. 30-434.1 makes owners of a two-unit project live in one unit unless the lot came from an urban lot split, and bars renting any unit for under 30 days.

For investors: Fontana's two-unit path suits owner-occupants, not absentee investors: only individuals or trusts may apply, not LLCs, and the owner must live on site unless the lot came from an urban lot split. A pure rental hold fits the ADU route better.

Source: Fontana Zoning and Development Code Sec. 30-434.1 (Two-unit projects), Oct 2026

Rental registration and inspection

  • Fontana Code Sec. 15-36(c) requires an annual business tax from anyone renting more than one single-family house, or any apartment units, inside the city.

For investors: One rented Fontana house falls below the line, but a second house or any duplex brings you in. Renewals are due yearly, and a late license tax picks up a 20% penalty on day 31 plus 20% each month after, up to double.

Source: Fontana Code of Ordinances, Chapter 15 Article II (Business License Taxes), Oct 2026

  • Fontana's rental business tax runs $12 on gross rents under $3,000, then climbs in per-$1,000 steps to $3.50 per $1,000 above $20,000, plus a $35 application fee and a $4 state fee.

For investors: A fourplex collecting $96,000 a year works out to about $314 in annual tax, small beside insurance. The application is also routed to planning and building review, so file before the first Fontana lease is signed.

Source: City of Fontana, Rental Business Tax Application (Tax Rate Schedule R), Oct 2026

Short-term rentals

  • Fontana taxes occupancy of 30 consecutive days or less at 8% of rent (Code Sec. 10-222), and each operator must obtain a transient occupancy registration certificate within 30 days of starting.

For investors: The tax applies to any guest stay, yet Fontana's ADU and two-unit sections ban those stays outright. Confirm with Planning that a main house in your zone may host before buying with nightly income in the pro forma.

Source: Fontana Code of Ordinances, Chapter 10 Article VII (Transient Occupancy Tax), Oct 2026

Landlord rules

  • Fontana Police run a Crime-Free Multi-Housing Program that owners and managers of apartment and condo complexes and mobile home parks can join, pitched as a route to steadier tenants and lower repair costs.

For investors: Joining is voluntary, but for a buyer of a Fontana small apartment building it signals active management to neighbors and police. Ask the seller whether the property is enrolled and how tenant screening has been handled.

Source: City of Fontana Police Department, Crime-Free Multi-Housing, Oct 2026

Property tax

  • Fontana's FY 2025 financial report says 22 Mello-Roos community facilities districts issued special tax bonds between 1988 and 2024, repaid only from annual special taxes on parcels inside them.

For investors: Districts such as Sierra Lakes, Citrus Heights North and Bella Strada add special taxes to the tracts they cover, so two similar Fontana houses can carry very different bills. The city collects as agent and can start foreclosure on unpaid levies.

What drives rental demand

  • Kaiser Permanente is Fontana's largest employer with 7,587 workers in 2025, followed by Fontana Unified School District at 4,080 and Amazon at 3,059, per the city's ACFR.

For investors: Kaiser's medical center outweighs the next two employers combined, and the Southern California Permanente Medical Group adds 2,113 more. Rentals within an easy drive of that campus draw a deep pool of health care workers on steady paychecks.

Market note

  • Industrial landlords Duke Realty and Rexford Industrial lead Fontana's 2025 property taxpayer list, and the ten largest taxpayers hold 8.99% of taxable assessed value, up from 5.24% in 2016.

For investors: The logistics build-out brings warehouse and distribution jobs, including Walmart's distribution center staff, that feed demand for workforce rentals. It also brings truck traffic, so weigh a rental's distance from industrial corridors.

Hazards and insurance

  • Fontana's General Plan safety chapter names the San Andreas, San Jacinto and Cucamonga faults as the city's main seismic threats and says much undeveloped land lies in High or Very High Fire Hazard Severity Zones.

For investors: Earthquake cover is a separate policy in California, and wildfire zoning shapes which carriers will write a Fontana home. Get an insurance quote and the parcel's fire zone before locking a price, since premiums feed straight into DSCR.

Utilities

  • Fontana's water service map splits the city among Fontana Water Company, Cucamonga Valley Water District, West Valley Water District and two mutual companies, Marygold and Crawford Canyon.

For investors: Rates, deposits and owner-versus-tenant account rules depend on which provider serves the parcel. Confirm the purveyor from the city map before estimating owner-paid water on a Fontana duplex or fourplex.

Investor Questions

Fontana Investor FAQ

Can a Fontana ADU be listed for nightly guests?

No. Sec. 30-467 forbids renting an ADU or junior ADU for less than 30 days, regardless of when it was built. ADUs can be leased monthly but cannot be sold separately from the main house.

When does a Fontana landlord owe the city's rental business tax?

Sec. 15-36(c) applies once you rent more than one single-family house or any apartment units in the city. The tax is annual, and a late license tax adds 20% on day 31 and 20% more each month, with penalties capped at the amount of the tax.

Will a Fontana SB 9 duplex work as a pure rental?

Usually not. Fontana requires owners of a two-unit project to live in one unit unless the lot came from an urban lot split, only individuals or trusts may apply, and no unit may be rented for under 30 days.

Which Fontana workplaces drive rental demand?

Kaiser Permanente leads with 7,587 employees, followed by Fontana Unified School District (4,080) and Amazon (3,059), according to the city's FY 2025 financial report. Distribution centers and St. Bernardine Medical Center also make the top ten.

Products shown are business-purpose investor loans (such as DSCR) secured by non-owner-occupied property. They are not consumer mortgages and are not intended for personal, family, or household use.

Estimates are based on the information you provide and assume it is accurate and complete. Actual terms depend on full underwriting, appraisal, title, and program eligibility and may differ. The rate shown is the note rate, not the APR; figures exclude taxes, insurance, and certain third-party costs. The payment shown is principal and interest, or interest only where an interest-only option was selected; interest-only payments do not reduce the loan balance and the payment increases when the interest-only period ends.
