Short-term rentals
Brookhaven issues short-term rental permits only to owner-occupants who have owned the home for more than a year and receive a DeKalb County homestead exemption, so a non-owner-occupied investment property cannot qualify.
For investors: Brookhaven is effectively closed to investor-owned Airbnbs, so price any house here on long-term rent. The homestead and one-year ownership tests also mean even a buyer who moves in waits a full year before hosting guests.

Permits cannot go to LLCs, partnerships or trusts, each owner may hold one permit, rentals are capped at 180 days per calendar year, and permits are limited to 5% of residential parcels per council district.
For investors: Holding title in an LLC, as many rental investors prefer, rules out a Brookhaven permit entirely. The 5% district cap also means a qualifying owner-occupant can still be turned away in a council district that has already filled its share.

A one-year Brookhaven short-term rental permit costs $25, must be renewed yearly, is refused renewal after two or more citations in the prior calendar year, and expires when the property changes owners.
For investors: Do not pay extra for a Brookhaven house because the seller holds a rental permit: it ends at closing, and a buyer must reapply after meeting the ownership and homestead tests. Two citations in one year can end even a careful host's permit.

Brookhaven's hotel-motel excise tax is 8% of the room charge, covers homes, condos and townhomes rented to guests, and is due on the 20th day after each monthly period closes.
For investors: Brookhaven's finance department collects this levy, and the city's rental rules require a monthly return even in months with no bookings. Confirm whether your booking platform remits the tax, and mark the 20th on the calendar either way.
