Local Rules

Investing in Houston: The Local Rules

Short-term rentals

  • Since January 1, 2026, renting a Houston dwelling, or part of one, for under 30 consecutive days requires a city certificate of registration costing $275 a year, valid only at its listed address.

For investors: Each Houston address needs its own certificate, and the online portal makes you start over if an application is not finished within an hour, so gather ID, the owner authorization form and listing links first. Certificates issued by December 31, 2026 run through December 31, 2027.

Source: City of Houston, Short-Term Rental Ordinance (Chapter 28, Article XXIII), Jan 2026

  • Houston short-term rental hosts must name an emergency contact reachable by phone during every stay who responds within one hour, complete human trafficking prevention training, and show hotel tax proof unless listing only on Airbnb.

For investors: The one-hour rule effectively requires a local manager for an out-of-state Houston owner. Hosts listing on Vrbo or their own site must upload proof of hotel tax registration or payment before applying, and Houston First collects that tax for the city.

Source: City of Houston Administration and Regulatory Affairs, Short-Term Rentals, Oct 2026

  • Starting January 1, 2027, Houston will tell booking platforms to remove short-term rental listings that lack a certificate, and each day an ordinance violation continues is a separate offense fined $100 to $500.

For investors: Platforms must pull a flagged Houston listing within ten business days of the city's notice, and lost bookings during a delisting can cost more than the fine. A buyer taking over an active listing should file for a new certificate at closing rather than lean on the seller's number.

Source: City of Houston ARA, Short-Term Rentals; Short-Term Rental Ordinance Sec. 28-723, Oct 2026

  • A Houston short-term rental certificate is void once the registrant sells or conveys the property, and a new owner, or a lessee for more than 30 days, must apply for a fresh certificate.

For investors: The seller's Houston certificate gives a buyer nothing, so plan for a new application and a pause in bookings after closing. Hosting future reservations on the old number would mean operating without a valid certificate.

Tax calendar

  • Houston's 7% hotel occupancy tax is collected by Houston First Corporation as the city's agent, with quarterly reports and payment due by the last day of the month after each quarter.

For investors: Late Houston returns draw 10% annual interest, plus a 15% penalty once an amount is a full municipal quarter overdue. Mark April 30, July 31, October 31 and January 31 on the calendar the day the rental goes live.

Source: Houston First Corporation, Hotel Occupancy Tax Filing and Remittance, Oct 2026

Rental registration and inspection

  • Houston requires apartment properties with three or more units to register for habitability inspections; the registration needs no renewal and stays valid until ownership changes, and condominiums are exempt.

For investors: A Houston triplex or fourplex counts, so update the registration with the new owner and appraisal district details after closing. The city's registration site says Habitability Ordinance violations carry fines of $500 to $2,000, with each day a separate offense.

Source: Houston Permitting Center, Multi-Family Habitability Registration, Oct 2026

Landlord rules

  • Houston apartment communities with ten or more units must also register ownership with the police department's multi-family unit, and owners must update that record within 30 days of a sale.

For investors: A ten-unit or larger Houston building carries a second filing beyond the habitability registration. Failing to register can bring criminal citations of $500 to $2,000 a day, so put the 30-day update on the closing checklist next to the utility transfers.

Source: City of Houston Multi-Family Rental Property Registration (Apartment Security Ordinance), Oct 2026

Property tax

  • Houston's city rate for tax year 2025 was $0.519190 per $100, and its charter revenue cap needs voter approval for city levy growth above the lesser of 4.5% or an inflation and population formula.

For investors: The cap restrains only the city's share of a Houston rental's bill; school, county, college and flood control levies sit outside it. Of the city rate, $0.115931 went to debt service, so price the full stack from the appraisal district record.

ADUs and lot splits

  • Houston's Livable Places rules, effective November 27, 2023, allow larger second dwelling units where deed restrictions permit, plus small 3 to 8 unit apartment buildings, courtyard lots and small-lot homes.

For investors: A Houston lot without restrictive covenants can now carry a bigger garage apartment, adding a second rent to the DSCR math. Pull the subdivision's recorded deed restrictions before buying for that plan, since they decide whether the extra unit is allowed.

Source: City of Houston Planning and Development, Livable Places Chapter 42 and 26, Nov 2023

  • Houston's City Attorney runs a deed restriction enforcement team that can sue for injunctions over restrictions on a lot's use, setbacks, lot size and the size, type and number of structures.

For investors: In Houston the city itself may enforce a subdivision's covenants, so a short-term rental, duplex conversion or added unit that breaks them invites a court order, not just a neighbor complaint. Read the recorded restrictions before buying in an older neighborhood.

Flood zones

  • Houston requires new construction in high flood risk areas to sit at least two feet above the 500-year flood elevation, or three feet for critical facilities and buildings in the floodway.

For investors: Raising a new or substantially rebuilt Houston rental to the 500-year line adds real cost, so price it before buying a teardown lot. The Floodplain Management Office gives address-level flood zone determinations and elevation certificates where available, and can flag unmapped drainage problems.

Hazards and insurance

  • FEMA's October 2026 list places Houston at Community Rating System Class 4, effective October 1, 2026, a 30% discount on flood policies in mapped high-risk zones; the city page still shows a 2012 Class 5.

For investors: Ask your agent to apply Houston's improved class at the next renewal of a rental's flood policy. New policies normally wait 30 days to take effect, so bind coverage well before closing rather than at the closing table.

What drives rental demand

  • Texas Medical Center describes itself as the world's largest medical complex, with more than 120,000 employees, about 10,000 patient beds and 10 million patient encounters a year.

For investors: That payroll of nurses, residents and researchers keeps Houston rentals within an easy commute of the medical center in demand, including furnished stays for visiting clinicians and patient families. Stays under 30 nights need a city STR certificate.

Investor Questions

Houston Investor FAQ

Does a Houston home rented for stays under 30 nights need city registration?

Yes. Since January 1, 2026, any Houston dwelling or part of one rented for under 30 consecutive days needs a city certificate of registration at $275 a year, valid at one address. A sale voids the certificate, so a buyer must apply again.

Who collects Houston's hotel occupancy tax from a host?

Houston First Corporation collects the city's 7% tax as the city's agent. Reports and payments are due quarterly, by April 30, July 31, October 31 and January 31, and late amounts draw 10% annual interest plus a 15% penalty after a full quarter.

How high must a new Houston rental be built in a flood area?

At least two feet above the 500-year flood elevation in high-risk areas, or three feet for critical facilities and floodway sites. The Floodplain Management Office can give address-level flood zone determinations and elevation certificates where available.

Does Houston inspect apartment buildings?

Yes. Under a 2009 ordinance, multi-family properties with three or more units register and are inspected on a rotating basis, with a goal of a four-year cycle. Inspectors look at structural, electrical, plumbing, mechanical and pool hazards and permit compliance.

Products shown are business-purpose investor loans (such as DSCR) secured by non-owner-occupied property. They are not consumer mortgages and are not intended for personal, family, or household use.

Estimates are based on the information you provide and assume it is accurate and complete. Actual terms depend on full underwriting, appraisal, title, and program eligibility and may differ. The rate shown is the note rate, not the APR; figures exclude taxes, insurance, and certain third-party costs. The payment shown is principal and interest, or interest only where an interest-only option was selected; interest-only payments do not reduce the loan balance and the payment increases when the interest-only period ends.

Compensation and fees vary by loan amount, program, and transaction and are finalized in your loan documents at closing.
