Local Rules

Investing in Denton: The Local Rules

Short-term rentals

  • Denton requires city registration before any whole unit or bedroom is offered for 24 hours to 29 days; the file needs a floor plan sketch and parking site plan, and registrations expire December 31.

For investors: Renewal season runs November 1 through December 31, and the city accepts only renewals in those weeks, so a buyer cannot file a new registration then. Letting a registration expire puts a residential address back in line under the 1,000 cap. Measure the driveway too, since parking caps guest cars.

Source: Denton Development Code, Sec. 5.3.5T, Short-Term Rental (Municode), Oct 2026

  • Denton issues at most 1,000 short-term rental registrations a year in its RR through R7 residential districts, apartments included, with a waiting list once full, two per parcel and none within 100 feet of another.

For investors: The 100-foot spacing rule means a neighbor's registered rental can block yours, whatever the citywide count. Confirm with Development Services that no registered rental sits within 100 feet before paying a premium for a house near UNT or the Square.

Source: Denton Development Code, Sec. 5.3.5T, Short-Term Rental (Municode), Oct 2026

  • Rentals in Denton's nonresidential districts sit outside the 1,000 cap and the spacing rule, but a multifamily development there may register no more than 10% of its units, with at least two allowed.

For investors: For a small apartment building zoned outside RR through R7, the two-unit minimum beats the 10% math: a 12-unit owner could register two units for furnished nightly stays while the rest stay on annual leases.

Source: Denton Development Code, Sec. 5.3.5T, Short-Term Rental (Municode), Oct 2026

  • Denton limits short-term guests to two adults per bedroom plus two more, never over ten people, caps cars at the off-street spaces, and requires listings to state both limits and ban party use.

For investors: A four-bedroom Denton house tops out at ten guests no matter how many beds it holds, so graduation and game-weekend revenue models should start there. Check that any inherited listing and rental contract carry the required occupancy, vehicle and no-party language.

Source: Denton Development Code, Sec. 5.3.5T, Short-Term Rental (Municode), Oct 2026

  • Denton's Development Services director may revoke a short-term rental registration after three property maintenance notices or citations at the address within 12 months, and the site cannot re-register for a year.

For investors: Noise, trash and sidewalk parking all count toward the three strikes, and a revoked address loses its slot under the cap. Use a local manager who answers the required emergency contact line and fixes complaints the same day.

Source: Denton Development Code, Sec. 5.3.5T, Short-Term Rental (Municode), Oct 2026

Permits and occupancy

  • Denton inspects a short-term rental within six months of a new registration, a transfer to a new owner, or permitted additions, and it notifies owners within 100 feet once a registration is approved.

For investors: Buying a registered Denton rental does not skip the city visit: the transfer itself sets a new inspection clock. Have smoke and carbon monoxide detectors, a fire extinguisher and the guest brochure ready before that inspection.

Source: Denton Development Code, Sec. 5.3.5T, Short-Term Rental (Municode), Oct 2026

Tax calendar

  • Denton levies a 7% city hotel occupancy tax, due by the 20th of the next month; operators owing under $500 a month or $1,500 a quarter may report quarterly instead.

For investors: A single Denton house with modest bookings can often file quarterly, which cuts paperwork. Unpaid hotel tax is a listed violation in the development code, so missed filings put the short-term rental registration itself at risk.

Source: Denton Code of Ordinances, Ch. 10, Art. V, Hotel Occupancy Tax (Municode), Oct 2026

ADUs and lot splits

  • Denton permits one accessory dwelling unit on single-family detached lots in RR through R7 and MN districts; on lots under 10,000 square feet it may not exceed 1,000 square feet or half the house.

For investors: Section 5.4.4A sets no owner-occupancy rule, so an investor can add a rentable backhouse. The unit cannot get its own water or sewer service and cannot be sold off separately, so its rent counts as added income on one parcel.

Property tax

  • Denton's fiscal 2025-26 city rate was $0.595420 per $100; for fiscal 2026-27 the September 22, 2026 council agenda proposed $0.548485, lower than the current rate but above the no-new-revenue rate.

For investors: The city's taxpayer impact statement put the median homestead's city bill about $203 lower at the proposed rate. Rental owners see a similar drop only if Denton Central Appraisal District values hold steady, so check the new value notice.

Hazards and insurance

  • The City of Denton ranks Class 5 in FEMA's Community Rating System on the October 2026 list, a 25% saving on eligible flood insurance policies, while unincorporated Denton County sits at Class 10 with none.

For investors: The city line matters: a rental just outside Denton's limits in unincorporated county land loses the discount entirely. Confirm the jurisdiction on the appraisal record before comparing flood quotes for creekside property.

What drives rental demand

  • The University of North Texas in Denton is a Carnegie R1 research university with nearly 44,000 students, by its own count.

For investors: A campus that size keeps demand for by-the-bedroom leases near campus and Fry Street steady through the academic year. Underwrite for the August lease cycle and summer turnover rather than assuming even monthly occupancy.

Utilities

  • Denton operates its own electric utility, Denton Municipal Electric, alongside city water, wastewater and solid waste departments; new water, wastewater and trash rate ordinances went to council September 22, 2026.

For investors: Council sets these rates on Public Utilities Board recommendations, and the 2026 ordinances replace ones adopted in 2024, so a lease that includes trash or sewer needs room for increases. Confirm which electric provider serves the address and who holds the account between tenants.
