Rent control and eviction rules
Ordinance 6160, approved in August 2025, limits an Elizabeth base rent increase to 3% or $20, whichever is less, once per 12 months, and extends rent control through December 31, 2027.
For investors: The city's January 2026 notice still quotes only 3%, but the ordinance adds the $20 ceiling, which applies whenever 3% of the base rent would exceed $20. Underwrite controlled Elizabeth units on the dollar cap and give tenants at least 30 days' notice.

Elizabeth's rent control chapter exempts buildings of two units or fewer and owner-occupied three- and four-unit buildings, along with hotels, motels and rooming houses.
For investors: Owner occupancy matters only for three- and four-unit buildings, and the city asks those owners for an Affidavit Proof of Residence form. A non-owner-occupied triplex is covered, while any duplex sits outside the chapter whoever lives there.

When an Elizabeth tenant leaves voluntarily or is evicted, the landlord may raise rent up to 20% for the next year, once per 12 months, by filing a statement with the Fair Rental Housing Board.
For investors: The statement must certify the tenant did not leave because of harassment or threats. Outside board-approved capital improvement or hardship increases, a turnover is the main chance to move a controlled Elizabeth rent by more than $20, so plan renovations around natural move-outs.

Elizabeth's Fair Rental Housing Board hears capital improvement, substantial rehabilitation and hardship applications; the filing fee is $50, or $100 when the income sought or money spent exceeds $5,000.
For investors: Capital improvements here exclude like-for-like work such as windows of similar quality or a swapped heating system, so routine replacements will not support a surcharge. Elizabeth buildings of 12 or more units must also keep a superintendent on the premises and accessible around the clock.
