Local Rules

Investing in Cape Coral: The Local Rules

Rental registration and inspection

  • Since January 1, 2026, every residential rental in Cape Coral, down to a single rented room, must be registered with the City Clerk and renewed each year on its registration anniversary.

For investors: Filing happens in the city's Energov Citizen Self Service portal, and the renewal date is the anniversary of your first filing, not January 1. Calendar it at closing, because renewing more than 30 days late adds a $50 fee and a code compliance referral.

Short-term rentals

  • Resolution 279-25 sets Cape Coral's yearly registration fee at $35 for a rental leased longer than six months and $350 for one rented for six months or less.

For investors: The tenfold gap matters for seasonal plans. A canal home leased to winter visitors for three or four months falls in the $350 short-term class, so carry that fee and the county tourist tax filings in the operating budget from the first season.

Source: City of Cape Coral City Clerk, Rental Property Registration (Resolution 279-25), Jan 2026

  • Lee County levies a 5% tourist development tax on Cape Coral stays of six months or less and collects it directly, while state sales tax on that rent goes to the Department of Revenue.

For investors: Two tax accounts are needed for direct bookings: one with Lee County for the tourist tax and one with the state. Booking platforms often remit for their own stays, but repeat guests who book directly leave the filing with the owner.

Landlord rules

  • Cape Coral code section 12-129 lets one owner register all units of a building on one parcel under a single registration and fee, and gives a new owner 30 days after a transfer to register.

For investors: A duplex or fourplex costs one Cape Coral registration, not one per door, provided you own every unit on the same parcel. The seller's filing does not cover you: submit your own within a month of closing and keep the contact details current.

Source: Cape Coral Code of Ordinances § 12-129 (Municode, Supplement 38), Oct 2026

  • Under section 12-129, a violation costs a Cape Coral owner $500 for a long-term rental or $1,000 for a short-term one, doubling for repeats within 36 months, and each day counts as a separate offense.

For investors: Registering a vacation home in the cheaper long-term class is its own violation, at $1,000 and then $2,000. The Special Magistrate has no discretion to lower these penalties, so pick the right class before the first booking goes live.

Flood zones

  • FEMA's new Flood Insurance Rate Maps for Lee County, the first comprehensive review in 14 years, took effect November 17, 2022 and set the base flood elevations Cape Coral construction must meet.

For investors: A zone determination or quote made before late 2022 may rest on the old panels. Run the address through the city's Forerunner lookup, which shows the current zone, base flood elevation and any elevation certificate already on file, before you bind a policy.

Source: City of Cape Coral Building Division, Flood Protection & Information, Nov 2022

  • Because so many Cape Coral lots were raised with fill, a Letter of Map Revision Based on Fill is the city's most common request to remove a parcel from FEMA's high-risk zone.

For investors: A filled lot shown in an A zone may qualify for removal, which can end a mandatory flood policy requirement. The city signs the needed Community Acknowledgment Form through its own permit type, and letters already granted can be searched in Forerunner.

Hazards and insurance

Permits and occupancy

  • Every repair or improvement to a Cape Coral building in the Special Flood Hazard Area needs a permit with a substantial improvement application, and work worth half the building's market value triggers full flood compliance.

For investors: Cape Coral counts a structure as compliant only at base flood elevation plus one foot, and homes built before 1993 may have no elevation certificate on file. A full remodel of an older house can cross the 50% line and turn a cosmetic flip into an elevation project.

Utilities

  • In Cape Coral's North 1 East Utilities Extension area, the line assessment on a 10,000 square foot parcel totals $25,538 for water, sewer and irrigation, plus a $6,750 capital facility expansion charge.

For investors: Parts of northern Cape Coral still run on wells and septic, and the extension program reaches them in phases. Ask whether a parcel is already assessed or sits in a future phase, since unpaid installments ride on the Lee County tax bill and usually stay with the property.

Source: City of Cape Coral Public Works, North 1 East UEP Assessment Costs, Oct 2026

  • After a Cape Coral Notice of Availability, developed lots have 180 days to connect to new water and sewer lines; the city lists a $310 meter fee, $225 deposit and $100 septic abandonment permit.

For investors: The city's FAQ also estimates $2,000 to $2,500 for a plumber to run all three services to the house and abandon the septic tank. With a tenant in place, schedule the hookup early in the 180 days so the switchover does not collide with a lease turnover.

Property tax

  • Cape Coral's fiscal 2027 budget, adopted September 24, 2026, kept the city operating millage at 5.1471, and the Fire Services Assessment and Solid Waste Assessment appear on the same tax bill as non-ad valorem charges.

For investors: The 5.1471 rate is only the city's slice of a Lee County bill. The city's checkbook lookup shows one parcel's city tax, assessments and fees together, a quick way to size the assessments a rental pays on top of millage before you set the escrow.

Investor Questions

Cape Coral Investor FAQ

Does a Cape Coral duplex need one rental registration or two?

One, if you own both units on the same parcel. Section 12-129 lets a single owner register all units in the building together for one yearly fee, $35 when leased longer than six months or $350 when rented for six months or less. A buyer must register within 30 days of the transfer.

What if a Cape Coral vacation rental is registered as long-term?

The code treats that as a violation with a $1,000 civil penalty, rising to $2,000 for a repeat within 36 months. The Special Magistrate cannot lower these amounts. A short-term registration costs $350 a year, so the penalty quickly outweighs the fee savings.

How can I check a Cape Coral lot's flood zone before buying?

Use the city's Forerunner lookup for the zone, base flood elevation and any elevation certificate on file. Lee County's maps changed November 17, 2022. Filled lots often seek a Letter of Map Revision Based on Fill, and Class 5 standing trims premiums 25% in A, AE and V zones.

What does city water and sewer cost on a Cape Coral lot still on well and septic?

In North 1 East the line assessment on a 10,000 square foot parcel is $25,538, plus a $6,750 capital facility charge. Once the city sends its Notice of Availability, a developed lot has 180 days to connect and pays meter, deposit, septic permit and plumber costs.
